HE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.29, Article 2, Chapter 8, (Zoning Code),
of the Hawaii County Code, as amended, is further amended to add
a-new subsection, to read as follows:
"7.29 (cccc). The district classification of the follow~-
ing area situated at Waiakea, South Hilo, Hawaii, shall be
Office Commercial (COm20):
Beginning at the Northwest corner of this parcel of land,
being also the Northwest corner of Grant 8583 to David McH.
Forb~~ and on the Southerly side of Lono Street, the
coordinates of said point of beginning referred to Govern
r~er~t Survey Triangulation Stat~:on "HALM" being 2903.06 feet
Soutlc~ and 6810.05 feet East, thence running by azi~tuths
~ne~.su~ed clockwise from True South:
1. 238° 10' 82.70 feet along the Southerly side of
Lono Street;
2. 328° 10' 82.70 feet along the remainder of
Grant 8583 to David Mch. Forbes;
3. 58° 10' 82.70 feet along Grant 9442 to Juichi
~`ukumoto ;
4. 1,48° 10' 82.70 feet along Grant 9872 to Henry K.
Martin to the point of beginning
and containing an area of
6836 Square Feet.
All as outl ined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
This subsection is conditioned upon the following:
(A) that the petitioner or his authorized representative
shall submit plans for and secure final plan approval,
including the change of use, within one (1) year from the
effective date of the change of zone; (B) that the develop-~
ment shall include the required parking. Further, the
access to the property shall meet with the approval of
the 10epartment of Public Works; and (C) that all other
rubs, regulations and r~;quirements shall be complied with.
Should any of the foregoing conditions not be :~aet, the
rezoning of the subject property to its original or more
appropriate zoning designation repay be initiated."
SECfiIC~'N 2. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SFC°Y'I®N 3 . 'This ordinance shall take effect upon its
approval.
