HILO, HAWAII, COVERED BY TAX 114 P KEY 2-R3-14:1 AND 33.
HE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.29, Article 2, Chapter 8 (Zoning Code) of
the Hawaii County Code, as amended, is hereby further amended by
adding thereto the following subsection:
"7.29(FFFF).The district classification of the following
area situated at Piihonua, South Hilo, Hawaii, shall be General,
Commercial (CG -20):
Beginning at the East corner of this parcel of laud, being
also the east corner of the Waianuenue Avenue and Yi,nools
Street intersection, the coordinates of said point of beginning
referred to Government Survey- Triangulation Station "HAaLAI"
being .3,125.16 feet. North and 2,533.04 feet East, running by
azimuths treasured clockwise f ron True South:
1. 560 48' 326.80 feet along the Northwest side of
W_a i anuenue Avenue;
2. 1.480 55' 100.00 feet along the Northeast side of
Ululani Street;
3. 2380 55' 114.00 feet;
4. 1480 55' 254.94 feet;
5. 2520 00' 147.24 feet alone the Southeast side
of wailuku Drive;
6. Thence on a curve to the right with a radius of
89.40 feet, the direct azimuth and
distance being 2900 27' 3011
111..20 feet;
7. 3280 55' 222.46 feet along the Southwest side of
Ni,noolo Street to the point of
beginning and containing an area of
78,647 square feet.
'All as outlined in red on the map attached hereto,
marked Exhibit 'A' and by reference made a part hereof.''
This ordinance shall take effect forthwith upon the conditions
that (A) the petitioner or its authorized representative shall
submit plans and receive approval for the consolidation of parcels 10
and 33 of Tax Map Key 2-3-14 prior to any change or use of Tax Map
fey 2-3-14:33; (B) the requirement of Rule No. 9, Relating to
Environmental Shoreline Protection, shall be complied with; (C) the
plans for the renovation of the existing buildings shall be submitted
and final plan approval received within one (1) year fro n the
effective date of approval of the change of zone or special management
area use permit, if the latter is applicable; and (D) all other
rules, regulations, and requirements shall be complied with. Should
any of the foregoing conditions not be met, rezoning of the area
to its original or more appropriate zoning designation may be
initiated.
SECTION 2. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts
of this ordinance.
SECTION 3. This ordinance shall take effect upon its approval.
