ARTICIaE 2, CHAPTER $ (ZONING CODE) OF TH]E HAWAII COUNTY CODE, AS
AMENDED, HY CHANGING THE DISTRICT CLASSIFICATION FROM VILLAGE

HH IT ORDAINED BY THH COUNCIL OF THH COUNTY OF HAWAII:
SECTION 1. Section 7.03, Article 2, Chapter 8, (Zoning Code),
of the Hawaii County Code, as amended, is further aat~ended to add a
new subsection to read as follows:
"7.03 ( bb ). The district classification of the
following area situated at ICeeekee 1st, South Kona, Hawaii,
shah. be Multiple Fa~n.ily Residential (RM®I.5)
beginning at a spike at the northeast corner of this parcel
of land, the coordinates of which referred to Governat~ent
Survey Triangulation Station "PUU OHAU" being 1,579.60 feet
North and 1,1,170.19 feet East and running by azimuths
nneasured clockwise froara true South
1. 9° 56' 14.90 feet along the westerly side of
Hawaii Helt Road to a pipe in
concrete;
Thence along same on a curve to the left with a radius of
2322.01 feet, the azimuth and distance of the chord being:
2. y° 22' 37" 45.10 feet to a pipe in concrete;
Thence continuing along same on the same curv€ to the left
with the same radius of 2322.01 feet, the azimuth and
distance of the chord being:
3. 7° 33' 20" 102.52 feet to a pipe in concrete
(found) ;
4. y0° 04' 258.37 feet along Kona Public Library,
Executive Order No. 1264, to
a pipe in concrete (found);
5. 187° 08' 102.83 feet along Lot l6°A of Land
Court Application 1609, to a
pipe in concretes (found);
6. 270° 09' 30" 92.32 feet along 1Gots 15 and 1 of
hand Court Application 1609 to
a pipe in concrete;
7. 1,88° 56' 88.32 feet along hot 1 of ~Gand Court
Application 1609 to a pipe in
concrete;
8. 279° 56' 165.45 feet along hots 3eE~l and 3®A

to the point of begi~aning and
containing an area of
0.885 Acres.
All as outlined in red on the a~ia.p attached hereto,
marked Exhibit "A" and, by reference made a part hereof.
This subsection is conditioned upon the following:
(A) that plans for the proposed service building .and
the additional parking area shall be submitted to the
Planning Department and final plan approval secured within
one (1) year from the effective date of the Change of Zone;
(~) that construction of the improve~aents commence within
one (1) year from the date of receipt of final plan approval
and be completed within three (3) years thereafter: (C) that
alb. other applicable rules, regulations, and requirements
be co~iplied with. Should any of the foregoing conditions
not b~ :net, rezoning of the area. to .its original or more
appropriate zoning designation znay be initiated. ~~
SECTIC~v 2. In the event that any portion of this ordinance
is declared invalid:, such invalidity shall not affect the other
parts of thiv ordinance.
SECTION 3. This ordinance shall take effect upon its
approval.
