AN ORDINAT~~CE AMENDING SECTION 7.20 (THE KURTISTOWN ZONE MAP),
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF fiHE HAWAII COUNTY CODE,
AS A?~~z NI3ED, EY Cf~.+.ANGING THE DISTRICT CLASSIFICAfiION FROM
AGRICULfiUP~~L (A~lOa) TO AGRICULTURAL (A--Sa) Afi OLAA, PUNA, HASti~AII,
COVERED HY fiAX MAP KEY 1~-7-O1:PORTION OF 25.
HE IT ORDAINED HY 'T'HE COUNCIL OF fiHE COUNTY OF HAWAII:
SECTION 1. Section 7.20, Article 2, Chapter 8, (Zoning Code),
of the H~.waii County Cods, as amended, is further amended to add
a naw subsection, to read as follows:
"7.20 ( f ). The district classification of the
following area situated at Olaa, Puna, Hawaii, shall be
Agr~.cultural (A-~5a)
Beginning at the Northwest corner of this parcel of land on
the Southerly side of the Roman Catholic Church Lot on the
Ols.a-~Keaau foundary, the coordinates of said poa.nt of beginning
referred to Government Survey Triangulation Station "OLAA"
beirsg 395.18 feet South and 671.12 feet East and running ]by
azi~~~uths measured clockwise from True South:
1. 274° 45' 1,599.28 feat along Olaa-Keaau Boundary;
2. 24° 25' 323.43 feet along Grant 8035 to Eugene
Weatherbee (Lot 2 of Olaa
Homestead Reservation Lots);
Thence along the remainder of
Grant 4460 to George ~I. Paty
(Lot l of Olaa Homestead Reserva°-
Lion Lots) on a curve to the
left with a radius of 1,442.7
feet, the chord azimuth and
distance being:
3. 27° 47' 30" 169.86 feet;
4. 24° 25' 130.96 feet along the remainder of
Grant 4460 to George ~P3. Paty
(Lot l of 01aa Homestead Reserva-
tion Lots);
5. 107° 16' 36" 1,524.16 feet along the same;
6. 207° 49' 275.65 feet along the same to the
point of beginning and containing
an area of 15.480 Acres.
All as outlined in red on the map attached hereto,
marked exhibit "A" and by reference made a part hereof.
This subsection shall take effect upon the conditions that
(A) tho petitioner or his authorized representative shall submit
a subdivision plan and secure tentative approval within one (1)
year from the effective date of the change of zone. The
petitioner/representative shall also be responsible for securing
final subdivision approval within one (1) year thereafter;
(B) the provision of access shall meet with the approval of the
Department of Public ~nTorks and the State Department of Transpor~
tation; and (C) all other applicable rules and regulations shall
be co~;plied with. Should any of the foregoing conditions not be
met, rezoning of the area to its original zoning or more appro~
priat~c designation may be initiated."
SECTION 2. In the even' that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 3. This ordinance shall take effect upon its approval.
