AN ORDINANCE AMENDING SECTION 7.03 (bb) (THE SOUTH KOTIA ZONE MAP),
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS
ANdENDED, HY CI3ANGING TE-IE CONDITIONS OF THE CHANGE OE' DISTRICT CLASSI-
FICA`T`ION FROM VILI,pAGE COMMERCIAL (CV@10) TO 1'~tU,LTIPLE FAMILY iESIDEN-
TIAL (RM~-1.5) AT KEEKEE ~.ST, SOUTH KONA, HAWAII, COVERED HY TAX MAP

HE IT ORDAINED L3Y THE. COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.03 (bb), Article 2, Chapter 8, (Zoning Coda),
of the Hawaii County Code, is mended to read as follows:
"7.03 (bb). The district classification of the
following area situated at Keeekee lst, South Kona, Hawaii,
shall be Multiple Family Residential (RM-1.5?:
Beginning at a spike at the northeast corner of this parcel
of land, the coordinates of which referred to GovErr~ment
Survey Triangulation Station "PUU OHAU" being 1.,579.60 feet
North and 11,170.19 feet East and running by azimuths
m~:asured clockwise from true South:
1. 9° 56' 1,4.90 feet along the westerly side of
Hawaii 73e1t Road to a pipe in
Concrete;
Thence along assns on a curve to the left with a radius of
2322.01 feet, the azimuth and distance of the chord being:
2. 9° 22' 37" 45.10 feet to a pipe in concrete;
Thence continuing along saan.e on the same curve to the left
with the same radius of 2322.01. feet, the azimuth and
distance of the chord being:
3. 7° 33' 20" 102.52 feet to a pipe in concrete
(.found) ;
4. 90° 04' 258.37 feet along Kona Public Library,
Executive Order No. 1264, to
a pipe in concrete (found);
5. 187° 08' 102.83 feet along Lot 16-A of Land
Court Application 1609, to a
pipe in concrete (found);
6. 270° 09' 30" 92.32 feet along Lots 15 and 1 of
Land Court Application 1609 to
a pipe in concrete;
7. 188° 56' 88.32 feet along Lot 1 of Land Court
Application 1609 to a pipe in
concrete;
8. 279° 56' 165.45 feet along Lots 3-D~1 and 3-A
of Land Court Application 1609
to the point of beginning and
containing an area of
0.885 Acres.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
This subsection is conditioned upon the following:
[(A) that plans for the proposed service building and
the additional parking area shall be submitted to the
Planning Department and final plan approval secured within
one (1) year from the effective date of the Change of Zone;
(E) that construction of the improvements commence within
one (1) year from the date of receipt of final plan approval
and be completed within three (3) years thereafter; (C) that
all other applicable rules, regulations, and requirements
be complied with. Should any of the foregoing conditions
not be met, rezoning of the area to its original or more
appropriate zoning designation may be initiated."] (A) that
the petitioner or his authorized representative submit plans
and secure final plan a royal within one (1) ear from the
effective date of the Chan a of zone; (~) that construction
of the pro Deed development commence within one (1} year
from the date of receipt of final plan approval and be com-
leted within two (2} ears thereafter; (C) that the re uire@
manta of the State Dew rtment of health be complied with;

all other a livable rules, re ulations and r uirements be

SECTION 2. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the brackets,
bracketed material and underscoring need not be included.
SECTION 3. In the event that any portion of this ordinance
is declared invalid, such Invalidity shall not affect the other
parts of this ordinance.
SECTION 4. This ordinance sha11 take effect upon its
approval.
