ORDINANCE N0.
AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 10, SECTION 13 OF THE
HAWAII COUNTY CODE RELATING TO FIXING DOG LICENSE FEES.
WHEREAS, Section 143-3, Hawaii Revised Statutes, as amended,
empowers each county council to fix the [annual] license fee
for dogs[;] on a biennial basis; and
WHEREAS, Section 143-2, Hawaii Revised Statutes, provides
that the legislative bodies of the several counties may, by
ordinance, dispense with or modify the licensing requirements
of Chapter 143;
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
COUNTY OF HAWAII:
Section 1. Chapter2, Article 10, Section 13 of the
Hawaii County Code, as amended, is further amended [by the
addition of Section 13] to read as follows:
"ARTICLE 10
MISCELLANEOUS
SEC. 13. DOG LICENSE FEES.
SEC. 13.01 AMOUNT OF FEES. The following fees are hereby
established as [annual] biennial license fees for the privilege
of owning, harboring or keeping of dogs in the County of Hawaii:
A. Sterilized dogs ['$1.00] $2.00
B. Unsterilized dogs [3.00] 6.00
SEC. 13.02 DEFINITION. For purpose of this section a
sterilized dog means a spayed female dog and a neutered male
dog.
SEC. 13.03 PROOF REQUIRED. Any person seeking to have
his dog licensed at the sterilized dog rate must present a
certificate from a veterinarian licensed to practice within
the State of Hawaii showing the description, age and breed of
the dog and certifying its sterilization.
Section 2. Material to be repealed is bracketed, new
material is underscored. In printing this ordinance, the
bracketed material or the underscoring may be excluded.
Section 3. This ordinance shall take effect on
January 2, 1981.
