AN ORDIiJANCE AMENDING SECTION 7.05 (°T°HE KAILUA-~HONALO URBAN
ZONE MAP}, ARTICLE 2, CHAPTEYZ 8 (ZONING CODE) OF THE HAWAII COUNTY
CODE, AS A~~FNDFD, BY CEIANGING THE DISTRICT CLASSIFICATION FROM.
SINGLE FAM7CLY RESIDENTIAL (RS~7.5) TO VILLAGE COMMERCIAL (CV-7.5)
AT KAWANUI 1ST, NORTH KONG, HAWAII, COVERED BY TAX MAP
REY 7®903:32.
BE IT OgtDAINED BY THE COUNCIL OF THB COUNTY OF HAWAII:
SECTION 1. Section 7.05, Articles 2, Chapter 8, (Zoning Code),
of the Hawaa~i County Code, as amended, is further amended to add
a new subsection to read as follows:
"7.05 ( z ). The district classification of the
following area situated at Kawanui let, North Kona, Hawaii,
shall be Village Commercial (CV-7.5):
Beginning at a spike at the southwest corner of this parcel
of land and on the easterly side of Mamalahoa Highway, the
coordinates of said point of beginning referred to Government
Survey Triangulation Station "PUU-O~-HAU" being 10,395.58 feet
north and 8,327.90 feet east and running by azimuths measured
clockwise from true South:
1. 175° 07' 221.71 feet along easterly side of
Mamalahoa Highway to a pipe
in concrete;
2. 26l° 30' 187.23 feet along roadway easement
to a pipe in concrete (found);
3. 355° 21' 170.38 feet along Lot B®1 to a pipe in
concrete (found);
4. 64° 46' 20" 119.03 feet along stonewall, along
Parcel B and Parcel C, Grant 987
to Pololi to a pipe in concrete;
5. 68° 5l' 20" 77.67 feat along stonewall along
Parcel C to the point of
beginning and containing an
area of 36,879 Square Feet.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
This subsection is conditioned upon the following:
(A) that the petitioners or their authorized representative
submit plans for the proposed development and secure Final
Plan Approval within one (1) year from the effective date
of approval of the change of zone; (B) that construction com~
mence within one (1) year from the date of receipt of Final
Plan Approval and be completed within two (2) years thereafter;
(C) that the .location of the driveway access shall meet with
the approval of the Department of Public ~Torks; and (D) that
all. other applicable rules, regulations and requirements be
complied with. Should any of thy: foregoing conditions not
be met, the rezoning of the subject property to its original
or more appropriate zoning designation may be initiated."
SECTION 2. In the event that any portion of this ordinance
is declared .invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 3. This ordinance shall take effect upon its
approval.
