AN ORDINANCE AMENDING SECTION 7.30 (THE PAPAIKOU-ONOMEA ZONE MAP),
ARTICLE' 2, CHAPTER 8 (ZONING CODE) OF` THE HAWAII COUNTY CODE, AS
AMENDET=i, HY CHANGING THE DISTRICT CLASSI~"TCATTON FROM AGRICULTURAL
(A-~20a) TO SINGLE FAMILY RESIDENTIAL (RS~10) AT PAPAIKOU, SOUTH
HILO, HAS^~AII, COVERI~D HY TAX MAP KEY 2-~7®04:119 (PORTION) .
DE TT ORDAINED ~iY THE COUNCIL OF` THE COUNTY OF HAWAII:
SECTION 1. Section 7.30, Article 2, Chapter 8 (Zoning Code),
of the Hawaii County Code, as amended, is further amended to add
a new subsection, to read as follows:
"7.30 ( e ). The district classification of the follow-
ing area situated at Papaikou, South Hilo, Hawaii, shall be
Single Family Residential (RS~10):
Beginning at a point at the north corner of this parcel of
land and at the southwesterly side of the Mill Road, the
coordinates of said point of beginning referred to Govern
meet Survey Triangulation Station "ALALA" being 19,374.72 feet
South and 6,104.05 feet East and running by azimuths measured
clock~,rise frore~ True South:
1. 321° 35' 257.57 feet along the southeasterly
side of the Mill Road;
2. 328° 42' 405.50 feet along the southeasterly
side of the Mill Road; thence
along remainder of R. P. 7875,
L. C. Aw. 11215, Apana 1 to
Aaron Kealiihonui along a curve
to the right having a radius of
10.00 feet, the chord azimuth
and distance being:
3. 13° 42' 14.14 feet; thence along the remainder
of R. P. 7875, L. C. Aw. 11215,
Apana 1 to Aaron Kealiihonui for
the next seven (7) courses:
4. 58° 42' 6.94 feet;
5. 71° 04' 83.99 feet;
6. 66° 07' 73.60 feet;
7. 155° 00' 385.90 feet;
8. 160° 00' 138.00 feet;
9. 137° 00' 115.98 feet;
10. 231° 57' 94.85 feet to the point of beginning
and containing an area of
1.9662 Acres.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
This subsection is conditioned upon the following:
(A) that the petitioner or its authorized representative
submit thy; subdivision plans and secure tentative approval
within one (1) year from the effective date of approval
of the change of zone. The petitioner/representative shall
also be responsible for securing final subdivision approval
within one (1) year from the date of receipt of tentative
subdivision approval; and (E) that all other applicable rules,
regulations and requirements be complied with. Should any of
the foregoing conditions not be met, rezoning of the area to
its original or more appropriate designation may be initiated."
SEC`T'ION 2. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts
of this ordinance.
SECTION 3. This ordinance shall take effect upon its
approval.
