AN ORDINANCE AMENDING SECTION 7.32 (THE HONOMU-HAKALAU ZONE MAP),
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS
AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL
(A-20a} TO SINGLE FAMILY RESIDENTIAL (RS-15) AT ~4TAILEA, SOUTH HILO,
HAWAII, COVERED BY TAX MAP KEY 2--9-03:11 CPORTION).
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.32, Article 2, Chapter 8 (Zoning Code),
of the Hawaii County Code, as amended, is further amended to add
a new subsection, to read as follows:
"7.32 ( a ). The district classification of the follow
ing area situated at Wailea, South Hilo, Hawaii, shall be
Single Family Residential (RS-15):
Beginning at a point at the north corner of this parcel of
land and on the southwesterly side of the Mamalahoa Highway,
the coordinates of said point of beginning referred to
Government Survey Triangulation Station "ALALA" being
17,668.70 feet North and 4,418.37 feet West and running by
azimuths measured clockwise from True South:
1. 331° 40' 339.05 feet along the southwesterly
side of the Mamalahoa Highway;
2. 340° 50' 54.91 feet along the westerly side
of the Mamalahoa Highway;
3. 20° 47' 53.73 feet along the westerly side
of the Mamalahoa Highway;
4. 71° 37' 59,08 feet alonq the southerly side
of the Mamalahoa Highway;
5. 103° 55' 72.34 feet along the southerly side
of the Mamalahoa Highway;
6. 151° 40' 309.33 feet along remainder of Grant
7396 to Wailea Milling Company,
Limited;
7. 221° 10' 172.00 feet along Grant 803 to Naai
to the point of beginning and
containing an area of 1.3949
Acres.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
This subsection is conditioned upon the following:
(A) that the petitioner or its authorized representative
submit the subdivision plans and secure tentative approval
within one (1) year from the effective date of approval of
the change of zone. The petitioner/representative shall
also be responsible for securing final subdivision approval
within one (1) year from the date of receipt of tentative
subdivision approval; and (B) that all other applicable
rules, regulations and requirements be complied with. Should
any of the foregoing conditions not be met, rezoning of the
area to its original or more appropriate designation may be
initiated."
SECTION 2. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 3. 'Phis ordinance shall take effect upon its
approval.
