HomeMy WebLinkAboutORD 1981-677 1980-1984BILL NO. ~,~~ COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO. ~y°~ f AN ORDINANCE AMENDING THE HAWAII COUNTY CODE, AS AMENDED, TO ADD A NEW CHAPTER ENTITLED "FIRE CODE OF THE COUNTY OF HAWAII." BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. The purpose of this bill is to amend the Hawaii County Code, as amended, by designating and adopting a new chapter entitled "Fire Code of the County of Hawaii." SECTION 2. The Hawaii County Code, as amended, is hereby further amended by adding a new chapter to read as follows: "CHAPTER FIRE CODE OF THE COUNTY OF HAWAII ARTICLE 1. Adoption of the State Model F-ire Code The State Model Fire Code as adopted by the Hawaii State Fire Council on April 6, 1979, pursuant to Act 241, Session Laws of Hawaii 1978, amending Chapter 132, Hawaii Revised Statutes, which incorporated the Uniform Fire Code, 1976 of the Western Fire Chiefs Association, Inc., is by reference incorporated herein and made a part hereof and is hereby adopted by reference, subject to the following amendments: Section 1.101 is amended to read as follows: 'Sec. 1.101. This Code shall be known as the I~awaii County Fire Code, may be cited as such, and will be referred to herein as "this Code."' Section 1.215 is amended to read as follows: 'Sec. 1.215 Board of Appeals. (1) Creation. There shall be and is hereby created a Board of Appeals, consisting of five (5) members who shall be qualified by experience and training to pass upon matters pertaining to fire safety and at least one of whom shall be by training and experience familiar with building structures and flammable materials.' The members of the Appeals Board shall be appointed by the mayor and confirmed by the council in the manner prescribed in Section 13-4 of the Hawaii County Charter, as amended, and the Appeals Board shall be governed by the provisions of said charter provision. Procedure. The proceedings of the Appeals Board shall be subject to the provisions of Chapter 91, Hawaii Revised Statutes, as amended. The Appeals Board shall adopt rules and regulations for conducting its meetings, hearings, and investigations in conformity therewith and may impose reasonable fees to cover the costs of such proceedings. Section 1.301(d) is added to read as follows: '(d) Permits are required under the following sections: 1. Sec. 8.103 (Compressed Gases) 2. Sec. 14.102 (Application of Flammable Finishes) 3. Sec. 15.103 (Flammable and Combustible Liquids) 4. Sec. 19.102 (Hazardous Chemicals) 5. Sec. 20.102(a) (Liquefied Petroleum Gases ) 6. Sec. 26.101 (Places of Assembly) 7. Sec. 30.101 (Tents and Air Supported Structures) ' -~ 2 m Section 1.301(e) is added to read: 'Permit fees: 1. There shall be an annual fee of $25.00 for a Section 8.103 permit. 2. There shall be an annual fee of $25.00 for a Section 14.102 permit. 3. There shall be a fee of $25.00 for tanks up to 4,999 gallons and $40.00 for tanks 5,000 gallons or larger for a Section 15.103 tank installation permit. 4. There shall be an annual fee of $25.00 for a Section 19.102 permit. 5. There shall be a fee of $25.00 for tanks of 125-499 gallons and $40.00 for tanks 500 gallons or larger for a Section 20.102 (a) tank installation permit. 6. There shall be an annual fee of $40.00 for a Section 26.101 permit. 7. There shall be a fee of $25.00 for each Section 30.101 permit.' Section 1.404 is amended by amending the definition of 'Building Code' to read: 'BUILDING CODE shall mean Chapter 15, Hawaii County Code, as amended.' Section 1.407 is amended by amending the definition of 'Electrical Code' to read: 'ELECTRICAL CODE shall mean Chapter 11, Hawaii County Code, as amended.' Section 1.418 is amended by amending the definition of 'Plumbing Code' to read: 'PLUMBING CODE shall mean Chapter 13, Hawaii County Code, as amended. "' ® 3 SECTION 3. Penalties. Any person who violates any provision of this Code shall for each violation be prosecuted as for a petty misdemeanor and may be fined not more than Five Hundred Dollars ($500). The imposition of a penalty for any violation does not excuse the violation or permit it to continue; and any person in violation of the provisions of this Code shall be required to correct or remedy such violations within a reasonable time. Unless otherwise specified, each ten (10) days that prohibited conditions are maintained shall constitute a separate offense. SECTION 4. In the event that any section of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 5. This ordinance shall take effect sixty (60) days after date of approval, but nothing in this ordinance shall be construed to prohibit any person from complying with the provisions of this new code and the amendments thereto adopted hereunder.
