BE IT ORDAINED BY THE COUNCII, OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.09, Article 2, Chapter 8, (Zoning Code),
of the ~Iawaii County Code, as amended, is further amended to add
a new subsection, to read as follows:
"7.09 ( p ) . The district classification of the
following area situated at Waimea, South Kohala, Hawaii, shall
be Single Family Residential (RS-20):
Beginning at a pipe at the northeast corner of this parcel of
land, the coordinates of said point of beginning referred to
Governynent Survey Triangulation Station "West Base" being
794.63 feet South and 5035.14 feet west and running by
szimuths measured clockwise from True South:
1. 7° 30' 220.00 feet along Lot "H", Grant 12,897
to John Vieira Jr. and ~~argaret V.
Toledo and along a 40~Foot Road to
a pipe;
2. 97° 30' 200.00 feet along Grant 7249 to Keao
Kailikini to a pipe;
3. 187° 30' 220.00 feet along Lot 6, Grant 12,534
to E. D. Podmore to a pipe;
4. 277° 30' 200.00 feet along Lot 2 to the point of
beginning and containing an area
of 1.0101 Acres .
All as outlined in red on the map attached hereto, marked
F;xhibit "A" and kay reference made a part hereof .
This subsection is conditioned upon the following:
(A) that the petitioner, Philippe rrtichel, shall be respon~-
sible for complying with all of the stated conditions of
approval; (H) that a subdivision plan shall be submitted and
tentative approval secured within one (1) year from the
effective date of approval of the change of zone. Final
subdivision approval shall also be secured within one (1) year
thereafter; (C) that prior to the issuance of final subdivi~
sion approval, a fee shall be paid to the Finance Director
of the County of Hawaii, the amount of said fee shall be the
approximate equivalent of the petitioner s share of a privately
initiated improvements district for Opelo Road, covering road
way, drainage, and related improvements, as determined by
the Chief Engineer. Further, should an Improvement District
or similar arrangements be initiated for the improvement
of Opelo Road, the petitioner shall automatically partici~
pate in such an arrangement. Should the individual
share for the Improvement District exceed the amount originally
contributed by the petitioner, then the petitioner shall
contribute towards the difference; (D) that construction of
a single family dwelling shall commence on the vacant lot
within one (1) year from the date of receipt of final subdivi-
sion approval and be completed within two (2) years thereafter;
(E) that the rules and regulations of the Department of Water
Supply shall be complied with; and (f) that all other
applicable rules, regulations and requirements shall be
complied with. Should any of the foregoing conditions not be
met, rezoning of the area to its original or more appropriate
zoning designation may be initiated."
SECTION 2. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
