SECTION 1. Chapter ~ of the Rawaii County Code, as
mended, is further sarended by adding the following article:
"ARTICLE 6.
VOTER PEGISTRATI01~
SECTION 1. DEF`I~~3ITIOIVS
~fae following definitions shall apply to the provisions
cont~i.ned in this article.
A. The terms "candidate" shall ~:ean an individual as
defined under Chapter 11 Fart III (B), "Election Campaign
Contributions and Expenditures" , ~€awaii Revised Statutes ,
a s a~~:nde d .
B. The terms "political party" shall wean any party ~~hich
was on the ballot at the last general election and any polit-
ical group which shall hereafter undertake to forte a political
ps.rty in the r~.anner provided for in Chapter 11 Part V,
"Parties", of the ~iawaii Revised Statutes, as a,ended.
C. The terms "cottee" shall mean any person as defined
under Chapter 11 Part XII (B), "Election Car,~paign Contributions
and Expenditures", Iiawaii Revised Statutes, as mended.

to do business in the State of Rawaii and whose principal
ba~.si~ss is furnishing data processing services.
SECTION 2. VOTER REGISTRATION CON~tTTER TAPES
SECTION 2.01. I~II~IITATION AS TO RENTERS AND USE
The County Clerk or his designated representative may
rent voter registration computer tapes to only candidates,
political parties, co~nittee or service bureaus, at rental
fees as hereinafter provided. The tapes shall be used only
for electioneering for public office purposes.
SECTION 2.02. RESTRICTION AS TO REbEASE OF TNFORI~IATION
The only voter registration infor~.ation that the County
Clerk or his designated representative ayaay release are tree
name, residence address, ~a.ailing address and representative
district and precinct, of a voter.
SECTION 2.03. CONDITIONS OP RENT
All of the following conditions shall be r~et before
voter registration computer tapes y be rented:
A. The applicant obtains the written permission of
the County Clerk or his designated representative.
E. The applicant agrees in ~rriting that he will not
use, sell or other rise release the voter registration co~.-
puter tapes or the duplicate for other than electioneering
for public office purposes.
C. The candidate, political party, committee or service
bureau renting the tape agrees in writing to return the tape
in the same condition as it was prior to renting it out,
reasonable wear and tsar excepted, no later than the date
specified by the County Clerk.
SECTION 2..04. CUARGES
A. The rental fee for the use of voter registration
computer tapes of the regular elections or the Office of
Iiawa~.a~an Affairs (O~,A.) elections shall be for twenty-five
dollars ($25.00) handling charge for each list plus $0.001
per registered voter for the first seventy-two (72) hours
of use .
B. After the first seventy-two (72) hours an additional
fee of twenty-five dollars ($25.00) per day or any fraction
thereof shall be charged to the renter.
C. In addition, there shall be charges to the renter
for any da~aage to the voter registration computer tapes
incurred during. the rental period.

Any person who uses infortn.ation found on the voter
registration cos~.puter tapes for any purpose other than for
electioneering purpose shall be guilty of a misde~.eanor.
Any person convicted of a xa~isdea~eanor under this article
shall be fined not ffiore than $1,000 or imprisoned not amore
than one year, or both."
SECTI0~1 3. This ordinance shall take effect upon its
approval.
