HomeMy WebLinkAboutORD 1981-689 1980-1984BILL NO. 730 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO." 689 AN ORDINANCE AMENDING SECTION 7.29 (THE CITY OF HILO ZONE MAP), ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS A?•IENDFD, BY CHANGING THE DISTRICT CLASSIFICATION FRO' SINGLE FAJ.11ILY RESIDENTIAL (RS -10) TO MULTIPLE FAR1ILY RESIDENTIAL (RM -7) AT NIAIAK.FA, SOUTH HILO, HAWAII, COVERED BY TAX TMAAP KEY 2-2-38:29. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.29, Article 2, Chapter 8, (Zoning Code), of the Hawaii County Code, as amended, is further amended to add a new subsection, to read as follows: 117.29 (1111). The district classification of the following area situated at Waiakea, South Hilo, Hawaii, shall be Multiple Family Residential (RM -7); Beginning at a point at the west corner of this parcel of land, the coordinates of said point of beginning referred to Government Survey Triangulation Station "HALM" being 5,820.94 feet South and 8,367.03 feet East, thence running by azimuths measured clockwise from True South: 1. 2380 10' 242.00 feet to a point on the south- west side of Kilauea Avenue; 2. 3280 10' 90.00 feet along the southwest side of Kilauea Avenue; 3. 580 10' 242.00 feet along Lot 3, Block 302, Waiakea Homestead H.ouselot; 4. 1480 10' 90.00 feet along Lot 15, Block 302, Waiakea Homestead Houselots, to the point of beginning and containing an area of 21,780 Square Feet, more or less. All outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof. This subsection is conditioned upon the following: (A) that the petitioner, Tildawn Boyes, Inc., shall be responsible for complying with all of the stated conditions of approval; (B) that plans for the development shall be submitted and final Plan Approval secured from the Planning Department within one (1) year from the effective date of approval of change of zone; (C) that the conversion of the proposed use shall be completed within one (1) year from the date of receipt of final Plan Approval; (D) that all structural improvements shall be designed in keeping with the existing char scter of the immediate neighborhood; (F) t:1at access to the property shall meet with the approval of the Department of Public Works; (F) that the sewage requirements of the appropriate County or State agencies, particularly those of the State Department of Health, shall be complied with; and (G) that all other applicable rules, regulations, and requirements be complied with. Should any of the foregoing conditions not be met, rezoning of the area to its original or another appropriate zoning designation may be initiated." SECTION 2. In the event that any portion of this ordinance is declare.d invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 3. This ordinance shall take effect upon its approval.
