AN ORDINANCE AMENDING SECTION 7.04 (THE KAILUA URBAN ZONE MAP),
P_RTIC~E 2 , CHAPTER 8 ( ZONING CODE ) OF THE HAG+)AI I COUNTY CODE , AS
AMENDER, ~' CHANGING TP=F DISTRICT CfaASSIPICATION FROM RESORT~-
HOTFI (v~~.25) To MUITIPT~ ~A~~1II,Y RESIDENTIAL (RM-4) AT PUAA 2ND,
NORTH KONA, HAWAII, COVERER RY TAX I'1AP KEY 7°5-09:52.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.04, Article 2, Chapter 8, (Zoning
Code), of the Hawaii County Code, as amended, is further amended
to add a new subsection, to read as follows:
"7.04 ( v ). The district classification of the
following area situated at Puaa 2nd, North Kona, Hawaii,
shah. be Multiple Family residential (RM®4):
Beginning at the most northerly corner of this parcel of
sand on the north side of Grant 7489, Apana 2 and on the
south side of L.C. Award 7715, Apana 13 to Iota Ka~tiehameha,
thy: c~sordinates of which referred to Government Survey
Tria~fgulation Station "KAHEIO" being 4595.57 feet north
a~°~d 142.28 feet west and running by azimuths measured
clocr~°~aise from True South
1. 354° 27' 327.78 feet along remainder of
Grant 7489:2 and Grant 4100:2;
2. 74° 02' 30" 150.54 feet along stonewall along
remainder of Grant 4100:2;
3. 76° 58' 212.96 feet along stonewall along
remainder of Grant 4100:2;
4. 151° 59' 414.14 feet along east side of Kuakini
Highway;
5. 264° 27' 517.47 feet along I.C. Aw. 7715,
Apana 13 to Iota Kamehameha
to point of beginning and
containing an area of
2.738 acres, more or less.
All as outlined in red on the map attached. hereto,
r?arked Exhibit "A" and by reference made a part hereof.
This subsection is conditioned upon the following:
(A) that the petitioner, Youth t^dith A Mission, Inc.
H~.waii, shall be responsible for complying with all of
the stated conditions of approval; (B) that the conditions
of Change of Zone Ordinance No. 569 shall be complied with;
(C) that the subject property shall be consolidated with
parc~:ls 3 and 51 of flax Map Key 7-Salo within one (1) year
from the effective date of the change of zone; and (D) that
all other applicable rules, regulations and requirements
be complied with. Should any of the foregoing conditions
not be met, rezoning of the area to its original or more:
appropriate designation may be initiated."
SECTION 2. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 3. This ordinance shall take effect upon its
approval.
