ORDINANCE N0.
AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 10 OF THE HAWAII COUNTY CODE, AS Ah9ENDED,
TO ADD A NEW SECTION RELATING TO A SERVICE FEE FOR DISHONORED CHECKS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 2, Article 10 of the Hawaii County Code is amended to add
a new section, to read as follows:
"SEC. 14. DISHONORED CHECK SERVICE CHARGE. In all instances where
mone~r due the County of Hawaii is paid by check or other negotiable instrument
and the check or other negotiable instrument is dishonored when presented for
payment, the Count, of Hawaii may assess and collect a service charge in the
amount of $7.50 a ag inst the maker of the check or negotiable instrument.
Payment of this $7.50 service charge shall be made in U.S. currency or other
form acceptable to the Director of Finance. All fees collected pursuant to
this section shall be placed in the custodv of the Finance Director for
deposit in the general fund."
SECTION 2. Material to be repealed is bracketed.
New material is underscored. In printing this ordinance, the brackets, bracketed
material and underscoring need not be included.
SECTION 3. If any provision of this ordinance or the application thereof to
any person or circumstances is held invalid, such invalidity shall not affect other
provisions or applications of the ordinance which can be given effect without the
invalid provision or application, and to this end, the provisions of this ordinance
are declared to be severable.
SECTION 4. This ordinance shall take effect upon its approval.
