ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 5, ARTICLE 3, SECTION 11 AND
12 OF THE HAWAII COUNTY CODE, AS AMENDED, RELATING TO
TAXICABS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 5, Article 3, Section 11 of the
Hawaii County Code is amended to read as follows:
"[SEC. 11. PENALTIES
Any person violating any of the provisions of this
Article shall, upon conviction thereof, be subject to a
fine not exceeding five hundred dollars ($500.00).]"
"SEC. 11. UNAU'T'HORIZED POSSESSION OF TAXICAB
PARAPHERNALIA.
"'N~~erson who does not possess a valid certificate
of convenience and necessity issued pursuant to the
provisions of Chapter 5,s Article 1 of the Hawaii County
Code, shall permit an~r motor vehicle owned, operated or
otherwise under the control. of such person to be equipped
with, car ~ or display any:
A. Taxi Meter;
B. Fare Box;
C. Taxicab Driver's Permit; and,
D. An,~ Sig'n, Light or other device that
identifies such motor vehicle as a taxicab."
SECTION 2. Article 3, Chapter 5 of Hawaii County Code
is amended by adding a new section to read as follows:
"'SEC. 12. PENALTIES
"Any person violating any of the provisions of this
Article shall, upon conviction thereof, be subiect to a
fine not exceeding five hundred dollars ($500.00)."
SECTION 3. Material to be repealed is bracketed.
New material is underscored. In printing this ordinance,
the brackets, bracketed material and underscoring need not
be included.
SECTION ~. If any provision of this ordinance or the
application thereof to any person or circumstances is held
invalid, such invalidity shall not affect other provisions
or applications of the ordinance which can be given effect
without the invalid provision or application, and to this
end, the provisions of this ordinance are declared to be
severable.
SECTION 5. This ordinance shall take effect upon its
approval.
