AN ORDINANCE AMENDING SECTION 7.29 (THE CITY OF HILO ZONE MAP),
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE,
AS AME~~DF>D, BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE
FAIL' R.:ESIDENTIAL (RS-10 ) TO GENERAL COMMERCIAL (CG-20 ) AT

BE IT ORDAINED Bat' THE COUNCIL OF THE COUNTY OF HAg~AII:
SECTION 1. Section 7.29, Article 2, Chapter 8 (Zoning
Code) of the Hawaii County Code, as amended, is further amended
to add a new subsection, to read as follows:
°7.29 (uuuu). The district classification of the
following area situated at Waiakea, South Hilo, Hawaii,
shall be General Commercial (CG-20):
Beginning at the northeast corner of this parcel of land and
on the southwesterly side of Kinoole Street, the coordinates
of said point of beginning referred to Government Survey
Triangulation Station "HALAL " being 822.32 feet South and
4,917.52 feet East, thence running by azimuths measured
clockwise from True South:
1. 328° 47' 93.49 feet along the southwesterly
side of Kinoolc Street;
2. 60° 55' 19.40 feet along Lot 17-L-2, Wailoa
Heights Lots, Land Court
Application 385;
3. 348° 20' 43.13 feet along same;
4. 63° 06' 141.91 feet along Lot 17-K-2, Wailoa
Heights Lots, Land Court
Application 385;
5. 168° 12' 30" 137.38 feet along Grant 12,352;
6. 240° 55' 42.52 feet along Lot 17-H, Wailoa
Heights Lots, Land Court
Application 385;
7. 233° 00' 38.75 feet along the remainder of
Royal Patent 7601, Land
Commission Award 2327 to
Barenaba;
8. 249° 26' 49.49 feet along same to the point
of beginning and containing
an area of 19,670 Square Feet.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
phis subsection is conditioned upon the following:
(A) that the petitioner or his authorized representative
shall be responsible for complying with all of the stated
conditions of approval; (B) that plans shall be submitted
and Final Plan Approval, in accordance with Chapter 8
(Zoning Code), Hawaii County Code, shall be secured from
the Planning Department within one (1) year from the
effective date of the change of zone; (C) that the
construction and/or renovation of the existing structure
shall commence within one (1) year from the date of
receipt of Final Plan Approval and be completed within one
(1) year thereafter; (D) that the sewage requirements of
the appropriate governmental agencies shall be complied
with; (E) that access to the proposed development shall
meet with the approval of the Department of Public Works;
(F) that a drainage system in accordance with the
standards of the Department of Public Works shall be
installed; and (G) that all other applicable rules,
regulations, and requirements shall be complied with.
Should any of the foregoing conditions not be met,
rezoning of the area to its original or more appropriate
designation may be initiated."
SECTION 2. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.

SECTION 3. This ordinanco shall take effect upon its
approval.
