~RCTION 1. Section 7.02, Article 2, Chapter 8, (Zoning Code),
of the Hawaii County Code, as amended, is further amended. to add
ne=~= suhsection, to read as follows:
"7.02 (ffff). The district classification of the
following area situated at Holualoa 1.st and 2nd, North Ana,
Hawaii, shall be Village Commercial (CV~10):

This subsection is conditioned upon the following:
(A) that the petitioner or his authorized representative
shall be responsible for complying with all of the stated
conditions of approval; CH) that plans for the entire develop
ment shall be submitted to the Planning Department s.nd Final
Plan Approval, in accordance with Chapter 8 (Zoning Code),
Hawaii County Code, be secured within one (1) year from the
effective date of approval of the change of zone; (C) that
construction for the entire development commence within one (1)
year from the date of receipt of Pinal Plan Approval, and be
completed within two (2) years thereafter; (D) that direct
access to the property from I~uakini Highway shall not be
allowed. Access from the 80~foot wide private roadway shall
meet with the approval of the Department of Public *slorks;
(E) that a drainage system in accordance with the standards
of the Department of Public Works shall be installed; a.nd
(P) that all other applicable rules, regulations and require-~
manta, including those of the Department of Water Supply and
State Department of Health be complied with. Should any of
the foregoing conditions not be met, rezoning of the ar€~a to
its original or more appropriate designation may be initiated,"
SECTION 2. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.

SECTION 3. This ordinance shall take effect upon its
approval.
