AN ORDINANCE. AMENDING CHAPTER 6 (TRAFFIC CODE), ARTICLE 11,
SECTION 10, AS AMENDED, RELATING TO THE OBSTRUCTION OF
INTERSECTIONS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 6, Article 11, Section 10--Obstruction
of Intersection, of the County Code, as amended, is further
amended as follows:
"SEC. 10. OBSTRUCTION OF INTERSECTION
A. No hedge, shrubbery, fence, or similar obstruction
shall be maintained or permitted within a radius
of thirty feet from the intersection of property
lines at the corners of any street or highway
intersection when any [point on such] part of
the obstruction within the [said] radius extends
to a [greater] height greater than three feet
above the nearest edge of the roadway of the
abutting street.
[B. The Chief of Police shall cause a notice to be
served upon the owner or occupant of all property
where violations of this section exist, to
remove such obstruction within one week from
the service of such notice.
C. If the obstruction is not removed, or its removal
is not commenced and diligently prosecuted within
the given time, the Chief of Police shall forthwith
notify the County Engineer of the Department
of Public Works of said obstruction and it
shall be the duty of the Department of Public
Works to remove said obstructions. All costs,
sustained or incurred in the course of so removing
the obstruction shall be paid by the owner, lessee,
or person in control of the obstruction, and the
County may institute action to recover the costs
and expenses for the removal of same.]"
SECTION 2. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material and underscoring need not be
included.
SECTION 3. If any provision of this ordinance or the
application thereof to any person or circumstances is held
invalid, such invalidity shall not affect other provisions
or applications of the ordinance which can be given effect
without the invalid provision or application, and to this
end, the provisions of this ordinance are declared to be
severable.
SECTION 4. This ordinance shall take effect upon its
approval.
