AN ORDINANCE AMENDING SECTION 7.03 (THE SOUTH KONA ZONE MAP),
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE,
AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE
FAMILY RESIDENTIAL (RS-10) TO VILLAGE COMMERCIAL (CV-10) AT
KEEKEE 2ND, SOUTH KONA, HAWAII, COVERED BY TAX MAP KEY
8-1-03:PORTION OF 33.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.03, Article 2, Chapter 8 (Zoning
Code), of the Hawaii County Code, as amended, is further
amended to add a new subsection to read as follows:
"7.03 ( ee ). The district classification of the
following area situated at Keekee 2nd, South Kona, Hawaii,
shall be Village Commercial (CV-10):
Beginning at a spike at the southwest corner of this
parcel of land, the coordinates of which referred to
Government Survey Triangulation Station "PUU OHAU" being
1,260.83 feet North and 10,993.23 feet East and running by
azimuths measured clockwise from true South:
1. 179° 02' 83.47 feet along remainder of Lot 14-B,
along remainder of Grant 977 to
Panaunau;
2. 275° 07' 46.90 feet along Kona Public Library
at Keekee 1st;
3. 343° 47' 64.91 feet along stonewall, along
Piopio Church lot;
4. 75° 02' 65.65 feet along Lot 14-A, along
remainder of Grant 977 to
Panaunau to the point of
beginning and containing an
area of 0.093 Acre.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
This subsection is conditioned upon the following:
(A) that the petitioner or its authorized representative
shall be responsible for complying with all of the stated
conditions of approval; (B} that the subject area shall be
consolidated with TM K: 8-1-03:11 within one (1) year from
the effective date of the change of zone; (C) that prior
to the construction of any improvements on the subject
area, plans shall be submitted to the Planning Department
and Final Plan approval, in accordance with Chapter 8
(Zoning Code), Hawaii County Code, as amended, be secured
from the Planning Department; (D) that a drainage system
in accordance with the standards of the Department of
Public Works shall be installed; and (E} that all other
applicable rules, regulations, and requirements be
complied with. Should any of the foregoing conditions not
be met, rezoning of the area to its original or more
appropriate designation may be initiated."
SECTION 2. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.
SECTION 3. This ordinance shall take effect upon its
approval.
