AN ORDINANCE AMENDING SECTION 7.29 (THE CITY OF HILO ZONE MAP),
ARTICL]~ 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS
AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRTCULZ°URAL
(A-10a) TO AGRICULTURAL (A-3a) AT KAUMANA, SOUTH HTLO, HAWAII,
COVERED BY TAX MAP KEY 2-5-02:28.
BE IT ORDAINED BY THE COUNCIL OF THB COUNTY OF HAWAII:
SECTION 1. Section 7.29, Article 2, Chapter 8 (Zoning Code),
of the Hawaii County Code, as amended, is further amended to add a
new subsection, to read as follows:
"7.29 (vvvv). The district classification of the
following area situated at Kaumana, South Hilo, Hawaii,
shall be Agricultural (A-3a):
Beginning at a pipe at the northwest corner of this
parcel of ]:and, the northeast corner of Lot 3 and on
the southwest side of Lot 7, the coordinates of said
point of beginning referred to Government Survey
Triangulation Station "HALM" being 12,314.44 feet South
and 12,594.02 feet West and running by azimuths measured
clockwise from True South:
1. 303° 57' 378.43 feet along Lot 7 to a pipe;
2. 33° 57' 1,225.94 feet along Lot 5 to a pipe;
3. 139° 54' 30" 42.08 feet along Kaumana Drive to
a pipe;
4. Thence along Kaumana Drive, along a curve to the right
having a radius of
825.00 feet, the chord
azimuth and distance being:
145° 46' 45" 168.77 feet
to the pipe;
5. 151° 39' 115.66 feet along Kaumana Drive to
a pipe;
6. Thence along Kaumana Drive, along a curve to the left
having a radius of
435.00 feet, the chord
azimuth and distance being:
146° 02' 85.15 feet to a
piPei
7. 213° 57' 1,065.84 feet along Lot 3 to the
point of beginning and
containing an area of
10.0001 Acres.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
This subsection is conditioned upon the following:
(A) that the petitioner or his authorized representative
shall be responsible for complying with all of the stated
conditions of approval; (B) that a drainage system in
accordance with the standards of the Department of Public
Works shall be installed; (C) that subdivision plans shall
be submitted and tentative approval secured within one (1)
year from the effective date of approval of the Change of
Zone. Final subdivision approval shall be secured within
one (1) year thereafter; (D) that agricultural pursuit
shall be engaged on one (1) of the proposed lots within
two (2) years from the date of receipt of final sub®
division approval; (E) that no buildings other than that
related to agricultural use shall be erected or placed
on the lots. As used herein, "agricultural" shall be
defined as uses permitted within the State Land Use
Commission's District Regulations; and (F) that all
other applicable rules, regulations, and requirements,
including those of the Department of Water Supply, be
complied with. Should any of the foregoing conditions
not be met, rezoning of the area to its original or more
appropriate designation may be initiated."
SEC~TON 2. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
