ORDINANCE NO. ~~'~
AN ORDINANCE AMENDING SECTION 7.29 (THE CITY OF HILO ZONE MAP),
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE,
AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE
FAMILY RESIDENTIAL (RS-10) TO OFFICE COMMERCIAL (CO-20) AT
WAIAKEA, SOUTH HILO, HAWAII, COVERED BY TAX MAP KEY 2-2-23:7.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.29, Article 2, Chapter 8 (Zoning
Code) of the Hawaii County Code, as amended, is further amended
to add a new subsection, to read as follows:
"7.29 ( ccccc)• The district classification of the
following area situated at Waiakea, South Hilo, Hawaii,
shall be Office Commercial (CO-20):
Beginning at the east corner of this parcel of land, being
the south corner of Lot 15-A, a portion of Grant 8911 to
Meggie de Rego and on the northwesterly side of_ Lono
Street, the coordinates of said point of beginning
referred to Government Survey Triangulation Station
"HALAI" being 3,058.64 feet South and 6,574.51 feet East,
thence running by azimuths measured clockwise from True
South:

150.00 feet along Lono Street;
?_. Thence along Lono Street on a curve to the right with
a radius of 20.00 feet, the
chord azimuth and distance
being: 103° 10'
28.28 feet;
3. 148° 10' 105.00 feet along Kinoole Street;
4. 238° 10' 170.00 feet along Lot 13,
Grant 8925;
5. 328° 10' 125.00 feet along Lot 15-A, a
portion of Grant 8911 to
Meggie de Rego to the point
of beginning and containing
an area of 21,164 Square
Feet.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
This subsection is conditioned upon the following:
(A) that the petitioner or its authorized representative
shall be responsible for complying with all of the stated
conditions of approval; (B) that plans shall be submitted
to the Planning Department and Final Plan Approval, in
accordance with Chapter 8 (Zoning Code), Hawaii County
Code, secured within one (1) year from the effective date
of the change of zone; (C) that the development shall
include the required parking. Further, the access to the
property shall meet with the approval of the Department of
Public Works; (D) that Lono Street, from the intersection
with Kinoole Street to the easternmost property line,
shall be improved, including the provision of curbs,
gutters, and sidewalks, as required by the Department of
Public Works; (E) that a drainage system in accordance
with the standards of the Department of Public Works shall
be installed; and (F) that all other rules, regulations
and requirements shall be complied with. Should any of_
the foregoing conditions not be met, the rezoning of the
subject property to its original or more appropriate
zoning designation may be initiated."
SECTION 2. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.

SECTION 3. This ordinance shall take effect upon its
approval.
