AN ORDINANCE AImIENDING SECTION 9, ARTICLE 17, CHAPTER 6,
HAWAII COUNTY CODE, RELATING TO THE IMPOSITION OF PENALTIES
FOR VIOLATORS OF ARTICLE 17, CHAPTER 6, HAWAII COUNTY CODE.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Article 17, Chapter 6, of the Hawaii County
Code, is amended by amending Section 9G to read as follows:
"G. Penalties.
1. Any person found guilty of violating any
provision of [the above sections] Sections 5 and 6 of
this Article shall be guilty of a ep tt~r misdemeanor and
shall be subject to a term of imprisonment not to
exceed 30 dates or a fine not exceeding [Twenty-Five
Dollars ($25.00)] $500.00 or both for each separate
offense.
2. Any person found ~uilt~ of violating any other
provision of this Article shall be guilty of a
violation and shall be subject to a fine not exceeding
$25.00 for each separate offense."
SECTION 2. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material and underscoring need not be
included.
SECTION 3. If any provision of this ordinance or the
application thereof to any person or circumstances is held
invalid, such invalidity shall not affect other provisions
or applications of the ordinance which can be given effect
without the invalid provision or application, and to this
end, the provisions of this ordinance are declared to be
severable.
SECTION 4. This ordinance shall take effect upon its
approval.
