HomeMy WebLinkAboutORD 1982-792 1980-1984BILL NO. 844 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO. 792 AN ORDINANCE AMENDING SECTION 7.28 (THE SOUTH HILO DISTRICT ZONE MAP), ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM; SINGLE FAfILY RESIDENTIAL (RS -10) TO VILLAGE COMMERCIAL (CV -10) AND FROM VILLAGE COMMERCIAL (CV -10) TO SINGLE FAMILY RESIDENTIAL (RS -7.5) AT PEPEEKEO AND MAKAHANALOA, SOUTH HILO, HAWAII, COVERED BY TAX IMAP KEY 2-8-07:66, 69 AND 2-8-23:1. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.28, Article 2, Chapter 8 (Zoning Code), of the Hawaii County Code, as amended, is further amended to add new subsections, to read as follows: "7.28 (F-1). The district classification of the following area situated at Pepeekeo and M akahanaloa, South Hilo, Hawaii, shall be Village Commercial (CV -10): Beginning at the north corner of this parcel in the center of Waimaauou Stream, the coordinates of said point of beginning referred to Government Survey Triangulation Station "ALALA" being 192.80 feet North and 869.57 feet East, and running by azimuths measured clockwise from True South: 1. 3000 44' 2. 2450 58' 3. 2970 39' 4. 3270 25' 5. 2520 41' 6. 3010 54' 30" 7. 3° 56' Along the centerline of Waimaauou Stream in all its windings, the direct azimuths and distances between points in said centerline for the next six (6) courses being: 164.79 feet; 130.00 feet; 83.00 feet; 190.00 feet; 108.00 feet; 171.00 feet to a point on the westerly side of Kumula Street; 291.61 feet along the westerly side of Kumula Street; thence 8. 400 17' 14" 9. 730 29' 29.5" 10. 700 20' 31" 11. 710 31' 19. 5" 12. 730 34' 07" 13. 1190 45' 02.9" 14. 1650 04' 15. 2550 04' 16. 1760 28' 17. 630 04' 18. 1650 04' 19. 1870 38' 30" along Kaakepa Street along a 28.44 feet; 70.44 feet along the easterly side of Alia Street; 15.00 feet along Kulaimano Park; 75.87 feet along Kulaimano Park; 30.67 feet along Kulaimano Park; 109.64 feet along Kulaimano Park; 570.52 feet along Kulaimano Park to the point of beginning and containing an area of 9.747 Acres. -2- curve to the right having a radius of 30.00 feet, the chord azimuth and distance being: 35.57 feet; thence along the northerly side of Kaakepa Street along a curve to the left having a radius of 540.00 feet, the chord azimuth and distance being: 59.34 feet; 392.54 feet along the northerly side of Kaakepa Street; thence along the northerly side of Kaakepa Street along a curve to the right having a radius of 2,970.00 feet, the chord azimuth and distance being: 122.34 feet; thence along the northerly side of Kaakepa Street along a curve to the right having a radius of 2,970.00 feet, the chord azimuth and distance being: 89.81 feet; thence along Alia Street along a curve to the right having a radius of 20.00 feet, the chord azimuth and distance being: 28.44 feet; 70.44 feet along the easterly side of Alia Street; 15.00 feet along Kulaimano Park; 75.87 feet along Kulaimano Park; 30.67 feet along Kulaimano Park; 109.64 feet along Kulaimano Park; 570.52 feet along Kulaimano Park to the point of beginning and containing an area of 9.747 Acres. -2- 7.28 (F-2). The district classification of the following area situated at Pepeekeo and Maka.hanaloa, South Hilo, Hawaii, shall be Single Family Residential (RS -7.5): Beginning at the southwest corner of this parcel of land, the coordinates of said point of beginning referred to Government Survey Triangulation Station "ALALA" being 1,092.59 feet South and 1,098.56 feet East and running by azimuths measured clockwise from True South: 1. 1650 04' 448.66 feet along remainder of R.P. 7192, L.C. Aw. 8559-B, Apanas 17 and 18 to Wm. C. Lunalilo to a point at the southerly side of Kaakepa Street; thence along the southerly side of Kaakepa Street along a curve to the left having a radius of 3,030.00 feet, the chord azimuth and distance being: 2. 2510 32' 44" 127.29 feet; 3. 2500 20' 31" 392.54 feet along the southeasterly side of Kaakepa Street; thence along the southeasterly side of Kaakepa Street along a curve to the right having a radius of 480.00 feet, the chord azimuth and distance being: 4. 2510 48' 15.5" 24.50 feet; thence continuing along Kaakepa Street along a curve to the right having a radius of 30.00 feet, the chord azimuth and distance being: 5. 3040 20' 46.67 feet along Kaakepa Street; 6. 3550 24' 441.89 feet along the westerly side of Kumula Street; thence along the westerly side of Kumula Street along a curve to the right having a radius of 375.00 feet, the chord azimuth and distance being: 7. 3590 40' 55.80 feet; 8. 30 56' 18.13 feet along the westerly side of Kumula Street; 9. 870 04' 246.77 feet along Lots 13, 14 and 15, Kulaimano Heights, Unit I; -3- 10. 750 00' 232.60 feet along Lots 15, 16, 17 and 18, Kulaimano Heights, Unit I to the point of beginning and containing an area of 5.894 Acres. All as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof. These subsections are conditioned upon the following: (A) that the petitioner or his authorized representative shall be responsible for complying with all of the stated conditions of approval; (B) that the subdivision plan for the Single Family Residential m 7,500 square foot (RS -7.5) zoned area shall be submitted to the Planning Department and tentative approval secured within one (1) year from the effective date of the change of zone. Final subdivision approval shall be secured within one (1) year thereafter; (C) that an Agreement shall be entered into with the Planning Department in order to assure that single family units will be constructed on the proposed lots. The Agreement shall be submitted at the time of subdivision review. Upon acceptance of the Agreement by the Planning Department and the Corporation Counsel, it shall be filed with the State Bureau of Conveyances; (D) that the consolidation and re -subdivision plans for the Village Commercial - 10,000 square foot (CV) zoned area shall be submitted to the Planning Department and tentative approval secured within one (1) year from the effective date of the change of zone. Final subdivision approval shall be secured within one (1) year thereafter; (E) that plans shall be submitted for one (1) of the proposed CV zoned lots and Final Plan Approval, in accordance with Chapter 8 (Zoning Code), Hawaii County Code, secured within one (1) year from the date of receipt of final subdivision -4- approval. Construction shall commence within one (1) year from the date of receipt of Final Plan Approval and be completed within. two (2) years thereafter. Construction on the remaining lots shall commence within one (1) year from the date of completion of the development of the first lot and be completed within two (2) years thereafter; (F) that a drainage system in accordance with the standards of the Department of Public Works shall be installed; (G) that the remaining section of Kaakepa Street, fronting TMK: 2-8-23:1, shall be improved, including the provision of curbs, gutters, and sidewalks, as required by the Department of Public Works. These improvements shall be completed prior to the development of the CV zoned lands; (H) that all applicable conditions spelled out in Ordinance No. 71 shall be complied with; and (I) that all other applicable rules, regulations, and rquirements, including those of. the State Department of Health, the County Department of Water Supply, and the Fire Department, shall be complied with. Should any of the foregoing conditions not be met, rezoning of the area to its original or more appropriate designation may be initiated." SECTION 2. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. -5- SECTION 3. approval.
