POSITIONS IN DEPARTMENTS, OFFICES AND OTHER AGENCIES OF THE COUNTY OF`

PAYROLL PERIODS, PAY DAYS, PRESCRIBING CERTAIN REQUIREMENTS ~~ITH RESPEC'T'

THE SALARY ORDINANCE OF 1982.
BE IT ORDAINED BY THE COUNTY COUNCIL OF THE COUNTY OF' HATr~TAII:
SECTION 1. Declaration of policy. It is the purpose of this
ordinance to fix and establish the number and rates of compensation for
all positions in departments and offices of the County of Hawaii under
the legislative control of the County Council pursuant to the provisions
of Section 3--14, County Charter, and chapters 76 and 77 of the Hawaii
Revised Statutes. This ordinance also covers other matters relating to
compensation of county employees. The term '°Employees" as used in this
ordinance shall include all officers.
SECTION 2. Payroll periods; pay days; fractional computation. All
salaries and wages shall be earned and payable in semi--monthly payroll
periods, from the first (1st) to the fifteenth (15th) of each month and
from the sixteenth (16th) to the end of each month;
The fifteenth (15th) day and last day of each month shall be the
pay days for all employees;
In the case where the required service has been rendered during a
full payroll period, one-half (1/2) of the monthly rate shall be paid;
The Director of Finance shall be authorized to approve payroll claims
covering compensation for fractional parts of a month computed otherwise
than in accordance with the foregoing requirements, in cases i~rherE
compliance with such requirements would result in hardship or unfairness
to the employees involved.
SECTION 3. Rate of compensation. (A) The monthly rates of
compensation for positions covered by the position classification plan
shall be based on the salary schedule, wage board salary schedule and
excluded managerial schedule as determined and fixed in accordance with
collective bargaining Agreements and all applicable laws thereto.
(B) Employees occupying positions not subject to the compensation schedule
set forth in subparagraph (A) hereinabove shall be paid at rates of com-
pensation as fixed and established by applicable provisions of the Hawaii
Revised Statutes and any act amendatory thereto, or any resolution in
pursuance thereof by the County Council in accordance with the following
schedule:

(E) The Mayor and t he Council shall review and compensate officers and
exempt employees at an appropriate step within a s alary range on the same
basis as employees o f bargaining units; provided, however, review and
compensation shall b e based on assuring a sensible relationship and
attracting and retai ning competent persons for cou nty service, estabm
lishing and maintain ing a high level of efficiency of such persons and
adequately compensat e them for the work they do.

SECTION 4. Employment governed by budget and appropriation.
Employees to fill the positions enumerated herein are to be employed as
needed and as specified in the respective applicable department budgets
approved for the year, or in ordinances or resolutions supplemental
thereto, to the extent that funds are available and appropriated by the
County Council as provided by law.
SECTION 5. Emergency Employment. When an emergency exists in the
opinion of the Mayor, and additional labor or service, not provided for
by this ordinance, is needed by the county to care for such emergency,
the Mayor is authorized to appoint to a position or employment with the
county any such person or persons as he deems necessary at rates within
the ranges of compensation prescribed herein, which are comparable to
the rates established hereunder in view of the labor or service to be

performed, to care for such emergency; provided, however, that no person
shall be so appointed unless at the time of appointment of such persons
there shall be available legally expendable funds sufficient for his
compensation. In the event the Mayor appoints any person or persons to
positions or employment under this section he shall report the same to
the County Council at its next regular meeting.
SECTION 6. Perquisites. That, pursuant to provisions of
Section 77-16, Hawaii Revised Statutes, each department head shall
determine, subject to the approval of the Mayor and under such directives
as he may issue, the reasonable value of allowance rendered to employees
in the form of quarters, heat, light, household equipment, and maid
service, laundry service or other perquisites at the expense of the
county but not for the convenience or benefit of the county and cause
the reasonable value of such allowances to be deducted from the compen®
sation of such employees. The department shall notify the employees
concerned of its findings and transmit the same to the Director of
Personnel and the Director of Finance.
SECTION 7. Official Fidelity Bonds. Pursuant to the provisions of
Sections 62-7 to 62-9, Hawaii Revised Statutes, and any act amendatory
thereto, or any provision passed in pursuance thereto by the County
Council, official fidelity bonds, filed and approved in the form and
manner set forth in Section 46-26 and 46-28, Hawaii Revised Statutes,
shall be required of the persons appointed to or occupying certain
positions enumerated in the above sections; said bonds shall be in the
custody of the Director of Finance, excepting the bond of the Treasurer
which shall be in the custody of the Mayor.
SECTION 8. That all positions in departments and offices of the
County of Hawaii under the legislative control of the County Council of
the County of Hawaii be and the same are hereby fixed and established
as follows:

SECTION 9. The positions and rates of compensation adopted in the
1982 budget of the County of Hawaii are hereby ratified and confirmed as of
July 1, 1982; and that any creation, reallocation of positions, salary
range reassignment or other changes of pay subsequent to the adoption of
said budget, shall take effect as authorized on the date of such creation,
reallocation, salary range reassignment or change of pay or a date otherwise
prescribed, subject to the certification of availability of funds by the
Director of Finance.
SECTION 10. Ordinance 700 and any resolutions amendatory thereto are
hereby repealed.
SECTION ll. The repeal of the ordinance, enumerated in Section LO
above, shall not affect any act done, ratified or confirmed, or any right
accruing and accrued or established, or any action, suit or proceedings had
or commenced in any several cause prior to said repeal, but all rights and
liability under said ordinance hereinabove repealed sha11 continue and
may be enforced in the same manner and with the same force as if said
repeal had not been made.
SECTION 12. Severability. If any section, or any part or clause of
any section, of this ordinance be decided by the Courts to be unconstitu-
tional or invalid, the same shall not affect the validity thereof which
can be given effect without that so decided to be unconstitutional or
invalid.
SECTION 13. This ordinance shall be known as the Salary Ordinance of
1982 and shall take effect as of July 1, 1982.
