AN ORDINANCE AMENDING CHAPTER 5, ARTICLE 1, SECTION 1.01, OF THE HA~n~AII COUNTY CODE, AS AMENDED, RELATING TO COMMON CARRIERS. HE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 5, Article 1, Section 1.01, of the Hawaii County Code is amended to read as follows: "SEC. 1.01 'Carrier' shall mean and include every person, individual, corporation, joint stock companies, firm, association, lessee, trustee, receiver or trustee appointed by any court who or which shall own, control, operate or manage passenger-carrying motor vehicle, such as sampan buses, taxis, and other vehicles exempted from the provisions of Chaper 271, Hawaii Revised Statutes, operated in the transportation of the general public, over a prescribed route on a regular schedule over any public street or highway within the County of Hawaii; [but not including: sightseeing buses, private transportation services of churches and employers, student transportation and any mass transit system owned, maintained and operated by the County of Hawaii including, but not limited to, motor buses, street railroads, fixed rail facilities, whether surface, subsurface or elevated.] but not including: (1)_persons transporting. passengers without char a in motor vehicles owned or o erated b suc er~on where such trans ortation i~ rovided in con-unction with and in furtherance of a related ri~-iar business ur ose or enter-rise of that person, except--that this exemption shall not aopl to persons maklnc~ an contract, a,reement or arran ~em~nt to ~rovi.de, x~rocur~ furnish or arran e for trans ortation as a travel a ant or broker or a arson en a ~d in_tour or si hts~~in activities, nor shall. this exam tior: a 1. where the tray: ortation is undertaken b a arson to evade the regulatory purposes of this chapter; (~ sightseeing buses; (3) private transportation services_of churches and employers; (4) student transportation;_and a ncs not (5 an mass transit s stem ownea,.maintained, erated by -the County of Hawaii including, but LidLC I.! In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
