SE IT ORDAINED HY TFiE COUNCIL OF TREE COUNTY OF HAWAII:
SECTION 1. Section 7.10, Article 2, Chapter 8 (Zoning Code),
of the Hawaii County Code, as mended, is further amended to add a
new subsection., to read as follows:
°7.1.0 ( e ). The district classification of the follow
ing area situated at Ouli, South Kohala, Hawaii, shall lee ~iul~

All as outlined in red on the map attached hereto,
marleed Rxhibit "A" and by reference made a part hereof.
This subsection is conditioned upon the following:
(A) the petitioner or its authorised representative shall
comply with the stated conditions of approval; (B) subdi~°
vision plans for the subject property shall be submitted
and tentative approval secured within one (1) year from
the effective date of the accompanying Special P?anagement
Area (SMA) Use Permit. Final subdivision approval shall
be secured within one (1) year thereafter; (C) plans shall

he submitted for the proposed development and Hinal Plan
=approval, in accordance with Chapter 8 (Zoning Code},
Ha~iaii County Code, shall be secured within one (l) year
from the date of receipt of Final subdivision Approval;
(D) construction shall commence within one (1) year from
the date of receipt of Final Plah approval and b~ completed
=,~*ithin three (3} years thereafter; (E) the requirements of
the Department of eater Supply shall be complied with;
(F} the method of sewage disposal shall meet with the
approval of the appropriate governmental agencies;
(G) that the requirements of the State Department of Transe
portation, Highways Division, be complied with; (H) drainage
system(s) in accordance with the standards of the Department
of Public Works shall be installed; (T) an intensive archae~
ological survey shall be conducted and the report filed with
the Planning Department prior to the development of the sub
jest area. Further, should any unanticipated archaeological
or historic features be uncovered during land preparation
activities, work shall cease immediately and the Planning
Department shall be notified. Work shall not resume until
clearance has been obtained from the Planning Department;
and (J) all other applicable rules, regulations and requires
menu shall be complied with. Should any of the foregoing
conditions not be met, rezoning of the area to its original
zoning designation may be initiated,'
SEC~TON ~. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.

SECTION 3. This ordinance shall take effect upon its
approval.
