AN ORDINANCE AMENDING SECTION 7.29 (THE CITY OF HILO ZONE MAP),
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS
AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL
(A-la) TO SINGLE FAMILY RESIDENTIAL (RS-10) AT PONAHAWAI, SOUTH HILO,
HAWAII, COVERED BY TAX MAP KEY 2-3-44: 17 & 18.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.29, Article 2, Chapter 8, (Zoning Code),
of the Hawaii County Code, as amended, is further amended to add
a new subsection, to read as follows:
"7.29 (eeeee). The district classification of the follow-
ing area situated at Ponahawai, South Hilo, Hawaii, shall be
Single Family Residential (RS-10):
Beginning at the West
West corner of Lot 34
on the Southerly side
of said point of begi
Triangulation Station
3476.83 feet West and
from True South:
corner of this parcel of land, the
of Crescent City Heights Subdivision,
of Likolehua Street, the coordinates

"HALM" being 2700.53 feet South and
running by azimuths measured clockwise
1. 254° 30' 296.11 feet along Lot 34 and Lot 35 of
Cresent City Heights Subdivision;
2. 324° 40' 262.53 feet along the remainder of
Grant 252 to Benjamin Pitman;
3. 54° 40' 278.55 feet along the remainder of
Grant 252 to Benjamin Pitman;
4. 144° 40' 363.00 feet along Lot 57 to the point
of beginning and containing an
area of 87,121 square feet or
2.000 acres, more or less.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
This subsection is conditioned upon the following:
(A) that the petitioner or its authorized representative
shall be responsible for complying with all of the stated
conditions of approval; (B) subdivision plans shall be
submitted and tentative approval secured within one (1)
year from the effective date of approval of the change
of zone. Final subdivision approval shall be secured
within one (1) year thereafter; (C) single family dwellings
shall be constructed on a minimum of two (2) of the proposed
lots within three (3) years from the date of receipt of final
subdivision approval; (D) a drainage system in accordance with
the requirements of the Department of Public Works shall be
installed; and (E) all other applicable rules, regulations
and requirements, including those of the Department of
Water Supply and the State Department of Health, be complied
with. Should any of the foregoing conditions not be met,
rezoning of the area to its original or more appropriate
designation may be initiated."
SECTION 2. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 3. This ordinance shall take effect upon its
approval.
