AN ORDINANCE AMENDING SECTION 7.29 (THE CITY OF HILO ZONE MAP),
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE,
AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM
AGRICULTURAL (A-la) TO NEIGHBORHOOD COMMERCIAL (CN-20) AT
PONAHAWAI, SOUTH HILO, HAWAII, COVERED .BY TAX MAP KEY 2-3-37:7.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.29, Article 2, Chapter 8 (Zoning
Code) of the Hawaii County Code, as amended, is further amended
to add a new subsection, to read as follows:
"7.29 (fffff). The district classification of the
following area situated at Ponahawai, South Hilo, Hawaii,
shall be Neighborhood Commercial (CN-20):
Beginning at the northeast corner of this parcel of land,
the coordinates of said point of beginning referred to
Government Survey Triangulation Station "HALAI" being
428.16 feet South and 56.21 feet East and running by
azimuths measured clockwise from True South:
1. 345° 40' 616.24 feet to the northwest side of
Ponahawai Street;
2. Thence along the northwest side of Ponahawai Street,
along a curve to the right
with a radius of 970.00 feet,
the chord azimuth and distance
being: 73° 40' 13"
67.58 feet;
3. 75° 40' 250.46 feet along the northwest side
of Ponahawai Street;
4. Thence along a curve to the right with a radius of
32.00 feet, the chord azimuth
and distance being: 120° 40'
45.25 feet;
5. 165° 40' 319.23 feet along the northeast side
of Komohana Street;
6. Thence along the northeast side of Komohana Street
along a curve to the left with
a radius of 2040.00 feet, the
chord azimuth and distance
being: 161° 54' 04"
267.95 feet;

7. 255° 40' 367.60 feet along the remainder of
Grant 252 to B. Pitman to the
point of beginning and
containing an area of
5.000 Acres.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
This subsection is conditioned upon the following:
(A) that the petitioner or its authorized representative
shall be responsible for complying with all conditions of
approval; (B) that the use of the subject property shall
be limited to medical services and ancillary facilities;
(C) that plans be submitted and Final Plan Approval
secured in accordance with the provisions of Article 22 of
Chapter 8 (Zoning Code) within one (1) year from the
effective date of the zoning ordinance; (D) that
construction shall commence within one (1) year from the
issuance of Final Plan Approval and be completed within
three (3) years thereafter; (E) that runoff generated by
the development shall be disposed of in suitable manner
meeting with the approval of the Department of Public
Works; (F) that there shall be no additional access points
onto Komohana Street from the subject property; and
(G) that all other rules, regulations, and requirements
shall be complied with. Should any of the foregoing
conditions not be met the rezoning of the subject property
to its original or more appropriate zoning designation may
be initiated by the Planning Director."
SECTION 2. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.

SECTION 3. This ordinance shall take effect upon its
approval.
