Yamashiro per Communication No. 918, dated September 8, 2000, regarding the change of zone request by Dennis Inouye, at Waiakea, South Hilo, Hawaii, TMK: 2-4-35:25, reports as follows: Bill No. 317 amends Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code by changing the district classification for 1.00 acre of land from an Agricultural (A-1 a) to a Residential and Agricultural (RA-.Sa) zoned district. The rectangulaz-shaped subject property, owned in fee by the applicant, is located approximately 500 feet west of Kupulau Road in the Mauna Kea View Estates Subdivision, which received Final Subdivision Approval on Mazch 3, 1993. In 1994, two single family dwellings were constructed on the subject pazcel, so the applicant is proposing to create atwo-lot subdivision consisting of .5 acres each. The General Plan LUPAG Map classification is Low Density Urban, which allows for single family residential, ancillary community and public uses, and convenience type commercial uses. The property is not situated within the Special Management Area. Surrounding lands aze zoned A-la, A-3a, and RS-10 and are located within the State Land Use Agricultural and Urban Districts. To the north and directly across of the property is the New Hope Church. There aze dwellings on both sides of the property and a vacant pazcel to the rear. Recent zonings were granted, and Ordinance No. 97-91 allowed the change of zone from A-1 a to RS-15 which allowed 25 lots to be constructed in the Kupulau Heights subdivision approximately .55 miles north of the subject property. Ordinance 99-91, the Waiakea Development Ventures across Kupulau Road to the east of the subject property, was granted a change of zone from A-3a to RS-10 for approximately 10.023 acres. The USDA soil type is Olaa, which is a very dark brown extremely stony silty clay loam about 16 inches thick with rapid permeability, slow runoff and slight erosion hazazd. This soil was used for sugarcane cultivation. The Land Study Bureau Soil rating is "C" or Fair. A portion of the property is located in Flood Zone AH, which if stricken by the 100-yeaz flood can average depths of one to three feet, will remain undeveloped. The existence of any raze or endangered flora or fauna or historical sites is remote, since the site has been previously developed. PC-117 ~ PC-117 Page 2 October 3, 2000 Access to the property is from Kupulau Road to a private roadway with an approximately 18-foot pavement within a 25-foot right-of--way. According to the Department of Public Works, a minimum 16-foot wide pavement within a 20-foot wide right-of--way is required from Kupulau Road to the westernmost lot. A future road widening is proposed for the mauka portion of Kupulau Road, which would result in an 80-foot right-of--way. All essential services and utilities aze available to the subject property. The on-site runoff is diverted to an existing drywell on Kupulau Road. Committee Member Curtis Tyler was concerned about the flooding issue and questioned the applicant if any flooding occurred on the property during the recent heavy rains. He also questioned him about the flood damage he experienced during the last torrential storm, and Mr. Inouye explained that the flooding resulted from the overflow of the drainage canal, located to the rear of their subdivision, which was inundated with debris. To justify the Urban zoning request, Committee Member Tyler questioned the applicant if he knew of other Urban zonings in the azea. The Planning Department then provided zoning maps to justify the amendment to the Urban zoned district. The Department of Public Works also provided flood maps to explain where the demarcation lines for the flood areas aze, and that the houses were constructed in "Zone X", an area outside of the flood area. Committee Member James Arakaki stated that he is in favor of this measure, but would feel more comfortable with it if second dwellings were not permitted on the lots; therefore, the standard language prohibiting the construction of second dwellings will be inserted as a condition in Bill No. 317, Draft 2. For informational purposes only, on the final vote, Committee Member Nancy Pisicchio voted "Kanalua" twice. Your Committee concurs with the Planning Commission and the Planning Director for recommending a favorable consideration for the change of zone request. Your Committee on Planning is in accord with the intent and purpose of Bill No. 317, as amended to Bill No. 317, Draft 2, and recommends it pass first reading.
