ORDINANCE NO.
AN ORDINANCE AMENDING SECTION 7.29 (THE CITY OF HILO ZONE MAP),
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE,
AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM
LIMITED INDUSTRIAL (ML-20) TO GENERAL COMMERCIAL (CG-20) AND
OPEN (O) AT WAIAKEA, SOUTH HILO, HAWAII, COVERED BY TAX MAP
KEY 2-2-47:6.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.29, Article 2, Chapter 8 (Zoning
Code), of the Hawaii County Code, as amended, is further
amended to add new subsections, to read as follows:
"7,29 (hhhhh~)• The district classification of the
following'~area situated at Waiakea, South Hilo, Hawaii,
shall be General Commercial (CG-20):
Beginning at the Southwest corner of this parcel of land,
on the North side of the Proposed Puainako Street
Extension (East), the coordinates of said point of
beginning referred to Government Survey Triangulation
Station "HALAI" being 7,763.01 feet South and
10,948.58 feet East and thence running by azimuths
measured clockwise from True South:
1. 175° 42' 532.48 feet;
Thence along a curve to the
left with a radius of
300.00 feet, the chord
azimuth and distance being:
2. 161° 56' 142.78 feet;
3. 148° 10' 3.27 feet;
4. 189° 30' 746.98 feet;
5. 270° 00' 1,043.23 feet along the South side of
the Proposed Makaala Street
Extension;
Thence along a curve to the
right with a radius of
30.00 feet, the chord azimuth
and distance being:
6. 315° 00' 42.43 feet;

the Proposed Ohuohu Street
Extension;
Thence along a curve to the
right, with a radius of
30.00 feet, the chord azimuth

of the Proposed Puainako
Street Extension (East), with
a radius of 2,340.00 feet,
the chord azimuth and
distance being:

The district classification of the
following area situated at Waiakea, South Hilo, Hawaii,
shall be Open (0):
Beginning at the Southwest corner of this parcel of land,
on the Easterly side of Kanoelehua Avenue, the coordinates
of said point of beginning referred to Government Survey
Triangulation Station "HALAI" being 7,656.16 feet South
and 10,717.79 feet East and thence running by azimuths
measured clockwise from True South:
1. 189° 30'
1,292.06 feet along the East side of
Kanoelehua Avenue;
Thence along a curve to the
right with a radius of
30.00 feet, the chord azimuth
and distance being:
2. 229° 45'
3. 270° 00'
4. 9° 30'
38.77 feet;
25.30 feet along the South side of
the Proposed Makaala Street
Extension;
746.98 feet;

Thence along a curve to the
right with a radius of
300.00 feet, the chord
azimuth and distance being:
6. 341° 56' 142.78 feet;
7. 355° 42' 532.48 feet;
8. 85° 42' 125.01 feet along the North side of
the Proposed Puainako Street
Extension (East);
Thence along a curve to the
right with a radius of
100.00 feet, the chord
azimuth and distance being:
9. 137° 36' 157.39 feet to the point of
beginning and containing an
area of 3.3613 Acres.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
These subsections are conditioned upon the
following: (A) that the individual(s) responsible for any
development of the subject property shall comply with all
of the stated conditions of approval; (B) that plans for
the entire development be submitted for Plan Approval
within one (1) year from the effective date of adoption of
the change of zone; (C) that construction of any proposed
improvements commence within one (1) year from the date of
receipt of Final Plan Approval and be completed within
three (3) years thereafter; (D) that a drainage system as
required by the Department of Public Works shall be
installed; (E) that Puainako Street and Makaala Street
shall be extended to the eastern end of the subject
property. Specific improvements within the rights-of-way
shall meet with the approval of the Department of Public
Works and the State Department of Transportation, Highways

Division, where applicable; (F) that Ohuohu Street shall
be extended throughout the length of the eastern property
line of the subject property between Puainako Street and
Makaala Street. The right-of-way width and specific
improvements shall meet with the approval of the
Department of Public Works; (G) that any improvements to
Kanoelehua Avenue shall meet with the approval of the
State Department of Transportation, Highways Division;
(H) that no direct access to the subject property shall be
allowed from Kanoelehua Avenue. All accesses shall meet
with the approval of the Department of Public Works and
the State Department of Transportation, Highways Division,
where applicable; (I) that curbs, gutters and sidewalks
meeting with the approval of the Department of Public
Works shall be provided fronting Puainako, Makaala and
Ohuohu Streets; (J7 that no structural improvements,
including parking, shall be constructed within the
drainage and planting easements unless the improvements
are necessary to accommodate drainage and landscaping
concerns; (K) that occupancy permits for any uses shall be
issued only upon completion of roadway improvements to
Puainako Street, Ohuohu Street and Makaala Street;
(L) that the method of sewage disposal shall meet with the
approval of the appropriate governmental agencies;
(M) that should any unanticipated archaeological remains
be uncovered during land preparation activities, work
shall immediately cease and the Planning Director
notified. Work shall not resume until clearance is
obtained from the Planning Director; and (N) that all
other applicable rules, regulations and requirements be

complied with. Should any of the foregoing conditions not
be met, rezoning of the area to its original or more
appropriate designation may be initiated."
SECTION 2. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.
SECTION 3. This ordinance shall take effect upon its
approval.
