ORDINANCE N0. 83
AN ORDINANCE AMENDING ARTICLE 16, CHAPTER 25 (ZONING CODE) OF THE
HAWAII COUNTY CODE 1983, AS AMENDED, RELATING TO PERMITTED USES
WITHIN THE LIMITED INDUSTRIAL (ML) ZONED DISTRICTS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 25-216, Article 16, Chapter 25 of the Hawaii
County Code 1983 is amended to read as follows:
"(3) Automobile parking lots, service stationsi and all
.uses and buildings for the repair, maintenance,
service, and storage of automobiles and trucks."
SECTION 2. Section 25-216, Article 16, Chapter 25 of the Hawaii
County Code 1983 is amended by deleting paragraphs (19) and (20)
from the list of permitted uses and re-numbering the remaining list
of permitted uses as follows:
"[(19) Public dumps.
(20) Sale, storage and sorting of junk, waste, scrap,
discarded or salvaged material, machinery,
automobiles br equipments, but not including
processing.]
[(21)](19) Retail sales incidental and subordinate to a
permitted use.
[(22)](20) Incidental and necessary services for persons
working in a ML district which are conducted within
an integral part of a main structure with entrances
from the interior of the building and having no
display or advertising visible from the street.
[(23)](21) Restaurants.
[(24)](22) Buildings and uses normally considered directly
accessory to the above permitted uses."
SECTION 3. Section 25-221, Article 16, Chapter 25 of the Hawaii
County Code 1983 is amended to read a5 follows:
"Section 25-221. OTHER REGULATIONS.
(a) Plan approval is required of all structures and
uses in ML districts.
(b) The following uses are allowed provided a "Use
Permit" is obtained from the planning commission:
(1) Public dumps.
(2) Sale, storage and sorting of junk, waste,
scrap, discarded or salvaged material, machinery,
automobiles or equipment, but not including
processing."
SECTION 4. Material to be repealed is bracketed. New material
is underscored. In printing this ordinance, the brackets, bracketed
material and underscoring need not be included.
SECTION 5. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts
of this ordinance.
SECTION 6
This ordinance shall take effect upon its approval.
