AN ORDINANCE AMENDING DIVISION 4, ARTICLE 1, CHAPTER 25 (ZONING
CODE) OF THE HAWAII COUNTY CODE 1983,'AS AMENDED, RELATING TO
VARIANCES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 25-27.1, Division 4, Article 1, Chapter 25
of the Hawaii County Code 1983 is amended to read as follows:
"Section 25-27.1. APPEAL OF DIRECTOR'S ACTION (8Y
APPLICANT).
(a) If the director denies the application, such decision
is final except that, within [ten working] thirty
days after notice of the decision, the applicant may
appeal such action to the planning commission."
SECTION 2. Section 25-27.2, Division 4, Article 1, Chapter 25
of the Hawaii County Code 1983 is amended to read as follows:
"Section 25-27.2. FURTHER APPEAL RIGHTS.
(a) All actions of the planning commission are final
except that, within [ten working] thirty days after
notice of action, the applicant or an "interested
party" (as defined in section 25-27.0 of this
article) in the proceeding before the planning
commission, may appeal such action to the boartl of
appeals in accordance with its rules."
SECTION 3. Material to be repealed is bracketed. New material
is underscored. In printing this ordinance, the brackets, bracketed
material and underscoring need not be included.
SECTION 4. In the event that any portion of this ordinance is
declared invalid, such invalidity. shall not affect the other parts
of this ordinance.
SECTION 5. This ordinance shall take effect upon its approval.
