AN ORDINANCE AMENDING DIVISION 10, ARTICLE 1, CHAPTER 25
(ZONING CODE) OF THE HAWAII COUNTY~CODE 1983, AS AMENDED,
RELATING TO FENCES AS ACCESSORY STRUCTURES: ACCESS TO MAIN
BUILDINGS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 25-65(a), Article 1, Chapter 25 of the
Hawaii County Code 1983 is amended to read as follows:
"Section 25-65. FENCES AS ACCESSORY STRUCTURES; ACCESS TO
MAIN BUILDINGS.
(a) [For the purpose of computing yards, a fence no
higher than six feet shall not be considered a
structure. All walls, fences and similar
structures over six feet in height shall be
considered as accessary structures and those up
to eight feet in height are exempt from the ten
feet separation between an accessory structure
and a main building.]
For the purpose of determining yard
requirements a fence less than six feet in
height shall not be considered a structure All
walls, fences and similar structures six feet
or over in height shall be considered as
accessory structures provided that those eioht
feet or less in height are exempt from the open
space requirement of ten feet between an
accessory structure and a main building Fences
which are constructed of strand material such
as barbed wire hoq wire or chain link which
allow "see-through" visibility are permitted to
a height of eight feet with no front side or
rear yard requirement "
SECTION 2. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material and underscoring need not be
included.
SECTION 3. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.
