HomeMy WebLinkAboutORD 1983-013 1980-1984BILL N0. 979 Dra t 3) COUNTY OF .HAWAII - STATE OF HAWAII ORDINANCE No. 83 13 AN ORDINANCE AMENDING ARTICLE 21, CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY CODE 1983, AS AMENDED, RELATING TO PLANNED UNIT DEVELOPMENT. BE IT ORDAINED 8Y THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 25-246, Article 21, Chapter 25 of the Hawaii County Code 1983 is amended to read as follows: "Section 25-246. MINIMUM AREA REQUIREMENT. The minimum area of a P.U.D. shall be [ten] two acres." SECTION 2. Section 25-246, Article 21, Chapter 25 of the Hawaii County Code 1983 is amended to read as follows: "Section 25-248. APPLICATION FOR P.U.D. APPROVAL. (a) Application for P.U.D. approval shall be made on a form prescribed by the planning department and shall be accompanied by: (1) Filing and processing fee of $100 [$1000 plus $25 per acre for each acre or fraction thereof]; and" SECTION 3. Section 25-256, Article 21, Chapter 25 of the Hawaii County Code 1983 is amended to read as follows: "Section 25-256. EXTENSIONS AND AMENDMENTS. [Extensions of time limitations] (a) Requests for time extensions and amendments to' the P.U.D. or its conditions may be granted by the planning department upon finding that no change [of conditions] has occurred in relation to the property since the initial P.U.D. approval or that the approval is still valid with respect to any changed conditions. [Application for any extension shall be filed in the office of the planning department not less than sixty days prior to the expiration date.] (b) Within forty-five days after receipt of an extension or amendment [such] application, the planning department shall [hold a hearing and] take action thereon and [if any extension is granted the planning department] may impose additional conditions [as required.] to meet the intent of the P.U.D. approval. (c) For any time extension, the application shall be filed in the office of the planning department not less than sixty days prior to the expiration date." SECTION 4. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included. SECTION 5. In the event that any portion of the ordinance is declared invalid, such invalidity shall not affect other parts of this ordinance. SECTION 6. This ordinance shall take effect upon its approval.
