ORDINANCE No. 83 2~
AN ORDINANCE AMENDING ARTICLE 22, CHRPTER 25 (ZONING CODE) OF THE
HAWAII COUNTY CODE, RELATING TO CLUSTER PLAN DEVELOPMENT.
BE IT ORDRINED BV THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 25-259, Article 22, Chapter 25 of the Hawaii
County Code is amended to read as follows:
"Section 25-259. Procedure for Cluster Plan Development.
(a) Application for C.P.D. approval shall be made on a
form prescribed by the planning department and shall be
accompanied by a filing and processing fee as set forth under
the subdivision code.
(b) The procedure for processing an application for
approval of C.P.D. shall be in the manner prescribed [in chapter
23, article 2, division 2 (subdivision code).) for a subdivision
application."
SECTION 2. Material to be repealed is bracketed. New material
is underscored. In printing this ordinance, the brackets, bracketed
mate-rial and underscoring need not be included.
SECTION 3. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts
of this ordinance.
SECTION 4. This ordinance shall take effect upon its approval.
