ORDINANCE NO Sa3 2'6
AN ORDINANCE AMENDING ARTICLE 9, CHAPTER 2, OF THE HAWAII
COUNTY CODE 1983 RELATING TO THE DEPARTMENT OF PUBLIC WORKS
DIVISION OF AUTOMOTIVE EQUIPMENT AND MOTOR POOL.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 2-41, Article 9, Chapter 2, of the
Hawaii County Code 1983 is amended by amending
subsection (a), paragraph (6 ), to read as follows:
"(6) Division of Automotive Equipment [and Motor
Pool]. The division of automotive equipment [and motor
pool] shall:
(A) Be responsible for the [custody,] repair[,] and
maintenance of all garage, shop, and automotive equipment of
the County, except such equipment as may be more practically
maintained by the department having control thereof as
determined by the chief engineer;
(B) Furnish [all] parts, accessories, gasoline,
lubricants, and tires necessary for the repair foz [all]
automobiles, trucks, shovels, cranes, graders, sweepers,
compressors, and other such machinery or equipment; and
[(C) Have all other duties as may be necessary to
carry out its functions.]
(C) Be authorized to bill any department agency oz
special fund for supplies, services, and use of equipment
SECTION 2. Division 2 of Article 9, Chapter 2, of the
Hawaii County Code 1983 is repealed.
SECTION 3. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material and underscoring need not be
included.
SECTION 4. If any provision of this ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions
or applications of the ordinance which can be given effect
without the invalid provision or application, and to this
end, the provisions of this ordinance are declared to be
severable.
SECTION 5. This ordinance shall take effect upon its
approval.
