ORDINANCE N0. 8~
AN ORDINANCE AMENDING SECTION 7.29 (THE CITY OF HILO ZONE MAP),
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE,
AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE
FAMILY RESIDENTIAL (RS-10) TO OFFICE COMMERCIAL (CO-20) AT
WAIAKEA, SOUTH HILO, HAWAII, COVERED BY TAX MAP KEY 2-2-24:13.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.29, Article 2, Chapter 8 (Zoning
Code) of the Hawaii County Code, as amended, is further amended
to add a new subsection, to read as follows:
"7.29 (iiiii). The district classification of the
following area situated at Waiakea, South Hilo, Hawaii,
shall be Office Commercial (CO-20):
Beginning at the northeast corner of this parcel of land,
being also the southeast corner of Lot 6 and along the
southwesterly side of Kilauea Avenue, the coordinates of
said point of beginning referred to Government Survey
Triangulation Station "HALAI", being 3,051.52 feet South
and 7,175.07 feet East, thence running by azimuths
measured clockwise from True South:
1. 340° 06' 85.86 feet along Kilauea Avenue;
2. 58° 10' 256.25 feet along Grant 9145 to
Mrs. Emma A. Naia (Lot 4);
3. 148° 10' 84.00 feet along Grant 9872 to Henry K.
Martin;
4. 238° 10' 274.00 feet along Grant 9206 to Henry T.
K. Kai (Lot 6) to the point of
beginning and containing an area
of 22,270 Square Feet.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
This subsection is conditioned upon the following:
(A) that the petitioner or authorized representative shall
be responsible for complying with all conditions of

approval; (B) that plans for Plan Approval shall be
submitted within one (1) year from the effective date of
the change of zone; (C) that construction of the proposed
building shall commence within one (1) year from the date
of receipt of Final Plan Approval and be completed within
two (2) years thereafter; (D) that only one (1) access
point strall be permitted off Kilauea Avenue; (E) that a
drainage system in accordance with the requirements of the
Department of Public Works shall be installed; and
(F) that all other applicable rules, regulations and
requirements shall be complied with. Should any of the
foregoing conditions not be met, the rezoning of the
subject property to its original or more appropriate
zoning designation may be initiated."
SECTION 2. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.
SECTION 3. This ordinance shall take effect upon its
approval.
