AN ORDINANCE AMENDING SECTION 7.02 (THE NORTH KONA ZONE MAP),
ARTICLE 7., CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE,
AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM
OPEN (O) TO GENERAL INDUSTRIAL (MG-la) AT HAMANAMANA, KALAOA
AND OOMA 1ST, NORTH KONA, HAWAII, COVERED BY TAX MAP KEY
7-3-43:PORTION OF 3.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.02, Article 2, Chapter 8,
"7.02 (hhh-1). The district classification of the
following area situated at Hamanamana and Kalaoa, North
Kona, Hawaii, shall be General Industrial (MG-la):
Beginning at the Northwest corner of this parcel of land,
the coordinates of which referred to Hawaii Plane
Coordinate Grid System, Zone 1 being 331,287.52 feet North
and 312,947.11 feet East and running by azimuths measured
clockwise from True South:
(Zoning Code), of the Hawaiian County Code, as amended, is
further amended to add new subsections, to read as follows:

Coordinate Grid System, Zone 1 being 328,141.07 feet North
and 315,723.45 feet East and running by azimuths measured
clockwise from True South:

following area situated at Kalaoa and Ooma 1st, North
Kona, Hawaii, shall be General Industrial (MG-la):
Beginning at the Southwest corner of this parcel of land,
the coordinates of which referred to Hawaiian Plane
Coordinate Grid System, Zone 1 being 324,396.72 feet North
and 312,253.90 feet East and running by azimuths measured
clockwise from True South:
1. 185° 00' 3,624.50 feet along remainder
of Government Land;
2. 275° 00' 345.00 feet along remainder
of Government Land;
3. 185° 00' 318.00 feet along remainder
of Government Land;
4. 275° 00' 984.00 feet along remainder
of Government Land;
5. 5° 00' 3,942.50 feet along remainder

All as shown on the map attached hereto, marked
ExY~ibit "A" and by reference made a part hereof.
These subsections are conditioned upon the
following: (A) that the petitioner or its authorized
representative shall be responsible for complying with all
of the stated conditions of approval; (B) that plans for
the first phase shall be submitted for Plan Approval
within one (1) year from the effective date of approval of
the change of zone; (C) that construction of the first
phase shall commence within one (1) year from the date of
receipt of Final Plan Approval and be completed within
two (2) years thereafter; (D) that prior to construction
of any subsequent phases, Final Plan Approval, in

accordance with Chapter 8 (Zoning Code), Hawaii County
Code, shall be secured from the Planning Department;
(E) that the creation of leaseable or rentable areas in
the upper industrial area where car rental agencies
maintain baseyards shall be through the Subdivision Code
of the County of Hawaii; (F) that the subdivision
requirements for such baseyard areas shall include
screening landscape similar to that provided in the
terminal and passenger parking areas. Such screening
shall encompass all views of the baseyard from the
Queen Kaahumanu Highway and the airport access road; and
(G) that all other applicable rules, regulations and
requirements shall be complied with. Should any of the
foregoing conditions not be met, rezoning of the area to
its original or more appropriate designation may be
initiated."
SECTION 2. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.
