AN ORDINANCE AMENDING ORDINANCE NO. 305 (ADOPTED MARCH 11,
1970), RELATING TO THE COST OF IMPROVEMENTS IN THE
"IMPROVEMENT DISTRICT NO. 7--KIMO PLACE ROAD," AND FIXING
THE PORTIONS OF THE COST TO BE ASSESSED AGAINST THE
BENEFITED PROPERTIES AND AGAINST THE OWNERS THEREOF, AND
IMPOSING THE LIEN AGAINST EACH LOT OR PARCEL OF LAND
ASSESSED ACCORDING TO THE ASSESSMENT, IN HILO, HAWAII.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Ordinance No. 305 is hereby amended to
reduce the total assessment (as shown on the preliminary
assessment roll) owed by each lot owner to:

which amended total assessment equals the original total
assessment proportionately reduced according to the square
footage of each lot relative to the square footage of the
total area assessed, and which amended total assessment is
calculated by the same method which was used to calculate
the original total assessment to be borne by each lot owner.
SECTION 2. Ordinance No. 305 is further amended to add
the following:
The Finance Director of the County of Hawaii is
authorized to distribute from any cash remaining in the
accounts of the improvement district, to the current lot
owners of each improvement district lot, an amount, if any,
equal to the total amount of assessment principal paid on
the lot less the amended total assessment; provided, that
the Finance Director may, in determining the amount of such
distribution, reduce said amount to such amount as will
facilitate the more efficient and expeditious payment of
such distribution; and provided, further, that the Finance
Director may reserve such amounts as he deems necessary to
cover any outstanding or anticipated debts or obligations of
the improvement district, including the costs and expenses
of making said distribution of funds to lot owners.

SECTION 3. This ordinance shall take effect on
March 1, 1983.
