ORDINANCE ~o. 873
AN ORDINANCE AMENDING SECTION 7.29 (THE CITY OF HILO ZONE MAP),
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE,
AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM
AGRICULTURAL (A-la) TO SINGLE FAMILY RESIDENTIAL (RS-7.5) AT
PONAHAWAI, SOUTH HILO, HAWAII, COVERED BY TAX MAP KEY 2-3-39:38.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.29, Article 2, Chapter 8 (Zoning
Code) of the Hawaii County Code, as amended, is further amended
to add a new subsection, to read as follows:
"7.29(mmmmm)• The district classification of the
following area situated at Ponahawai, South Hilo, Hawaii,
shall be Single Family Residential (RS-7.5):
Beginning at the West corner of this parcel of land, on
the northeasterly side of Wiliwili Street, the coordinates
of said point of beginning referred to Government Survey
Triangulation Station "HALAI" being 1,863.33 feet South
and 2,651.09 feet West and running by azimuths measured
clockwise from True South:
1. 236° 50' 330.62 feet along R. P. 5707,
L. C. Aw. 463 to
Kuihelani no
E. Kahakumakaliua;
2. 316° 15' 103.68 feet along the
remainder of Grant 252
to 8. Pitman;
3. 46° 15' 325.00 feet along Lot 60
(portion of Grant 252
to B. Pitman);
4. 136° 15' 164.40 feet along Wiliwili
Street to the point of
beginning and
containing an area of
1.000 Acre.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.

This subsection is conditioned upon the following:
(A) the petitioner, successors, or assigns shall be
responsible for complying with all of the stated
conditions of approval; (8) subdivision plans shall be
submitted within one year from the effective date of the
zone change. Final subdivision plans shall be submitted
within one year from the effective date of tentative
subdivision approval; (C) single family dwellings be
constructed on two of the proposed lots within three years
from the date of receipt of final subdivision approval;
(D) a drainage system as required by the Department of
Public Works shall be installed; (E) Wiliwili Street along
the frontage of the subject property shall be improved
with curbs, gutters and sidewalks meeting with the
approval of the Department of Public Works. Further,
should an improvement district or similar arrangements be
initiated for the improvement of Wiliwili Street, the
applicant shall automatically participate in the
improvement district petition, and this obligation shall
run with the land and be included as a covenant in any
conveyance document relating to the subject property; and
(F) all other applicable rules, regulations, and
requirements, including those of the Department of Water
Supply and the State Department of Health be complied
with. Should any of the foregoing conditions not be met,
rezoning of the area to its original or more appropriate
designation may be initiated."

SECTION 2. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.
SECTION 3. This ordinance shall take effect upon its
approval.
