COUNTY OF HAWAII - STATE OF HAWAII
ORDINANCE NO.% -
AN ORDINANCE AMENDING ARTICLE 1, CHAPTER 8 (ZONING CODE) OF THE
HAWAII COUNTY CODE, AS AMENDED, RELATING TO DEFINITIONS OF BOARDING
AND CARE HOMES AND DWELLING UNITS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 3.19, Article 1, Chapter 8 of the Hawaii
County Code is amended to read as follows:
"Sec. 3.19 [CARE HOME A facility which provides general
or rehabilitative care incident to old age or disability to
two or more persons unrelated to the operator for which
payment is received. These homes exclude admission of
residents less than semiambulatory or those needing
long-term nursing care.]
CARE HOME OR FAMILY CARE HOME. A facility which is
licensed by the State Department of Health to provide
general or rehabilitative care incident to old age or
disability in a group living arrangement in homes with not
more than one kitchen, to accommodate up to five persons,
whether or not such persons are related. The maximum five
persons permitted shall be in addition to the family or
staff operating the home."
SECTION 2. Section 3.34, Article 1, Chapter 8 (Zoning Code) of
the Hawaii County Code, is amended to read as follows:
"Sec. 3.34 DWELLING UNIT One or more rooms designed for
or containing or used as the complete facilities for the
cooking, sleeping and living area of a single-family only
and occupied by no more than one family and containing a
single kitchen."
SECTION 3. Section 3.50, Article 1, Chapter 8 (Zoning Code) of
the Hawaii County Code, is amended to read as follows:
"Sec. 3.50 FAMILY [An individual, or two or more persons
living together as a single domestic housekeeping group in
a dwelling unit, as distinguished from a fraternity or
sorority or a group occupying a boarding house, rooming
house, lodging house, dormitory, motel, hotel or other
commercial lodging house, dormitory, motel, hotel or other
commercial lodging establishment.]
An individual or two or more persons related by blood or
marriage, or a group of not more than five persons
(excluding servants), who need not be related by blood or
marriage, living together in a dwelling unit. The term
"family" shall also include individuals in larger group
living situations described under Family Boarding Home and
Care Home."
SECTION 4. Article 1, Chapter 8 (Zoning Code) of the Hawaii
County Code, is amended by adding a new section, designated as
Section 3.501 and entitled "Family Boarding Home or Adult Family
Boarding Home," to read as follows:
"Sec. 3.501 FAMILY BOARDING HOME or ADULT FAMILY BOARDING
HOME. A home which contains not more than one kitchen to
accommodate group living by not more than eight persons,
whether or not such persons are related, and which is
licensed by the State Department of Social Services and
Housing. The maximum eight persons permitted shall be in
addition to the family or staff operating the home."
SECTION 5. Material to be repealed is bracketed. New material
is underscored. In printing this ordinance, the brackets, bracketed
material and underscoring need not be included.

SECTION 6. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts
of this ordinance.
SECTION 7. This ordinance shall take effect upon its approval.
