ORDINANCE NO .+ ~`+
AN ORDINANCE AMENDING ARTICLE 3, CHAPTER 8 (ZONING CODE) OF THE
HAWAII COUNTY CODE, AS AMENDED, RELATING TO PERMITTED USES IN THE
SINGLE FAMILY RESIDENTIAL (RS) ZONE.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 3, Article 3, Chapter 8 of the Hawaii County
Code is amended to read as follows:
"Sec. 3. PERMITTED USES
A. Single family dwellings.
B. Golf courses where the edge of a tee or green is not
closer than one hundred (100) feet to any property
line.
C. Country clubs and golf club houses where no structure
or activity area such as pools, games, etc., is
located closer than two hundred (200) feet to any
property line.
D. Neighborhood parks, playgrounds, tennis courts, wading
pools and similar neighborhood recreational areas and
uses.
E. Growing and gathering of crops, fruits, vegetables,
flowers, trees and other plants provided no separate
building for retail outlet is constructed.
F. Home occupations.
G. Family care and family boarding homes.
[G.] H. Buildings and uses normally considered directly
accessory to the above permitted uses."
SECTION 2. Material to be repealed is bracketed. New material
is underscored. In printing this ordinance, the brackets, bracketed
material and underscoring need not be included.

SECTION 3. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts
of this ordinance.
SECTION 4. This ordinance shall take effect upon its approval.
