AN ORDINANCE AMENDING SECTION 7.29 (THE CITY OF HILO ZONE MAP),
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS
AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM GENERAL
INDUSTRIAL (MG-la) TO LIMITED INDUSTRIAL (ML-20) AT WAIAKEA, SOUTH
HILO, HAWAII, COVERED BY TAX MAP KEY 2-1-08:18.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.29, Article 2, Chapter 8 (Zoning
Code) of the Hawaii County Code, as amended, is further amended
to add a new subsection, to read as follows:
"7.29 (nnnnn). The district classification of the
following area situated at Waiakea, South Hilo, Hawaii,
shall be Limited Industrial (ML-20):
Beginning at the north corner of this parcel of land,
being also the west corner of Parcel B-1 and on the
southeasterly side of Kalanianaole Street, the coordinates
of said point of beginning referred to Government Survey
Triangulation Station "HALAi", being 3,223.68 feet North
and 13,126.47 feet East, thence running by azimuths
measured clockwise from True South:
1. 334° 25' 48" 506.25 feet along the remainder
of Grant 11,646 to
Theo. H. Davies and Co.,
Ltd. (Parcel B-1);
2. 90° 00' 316.83 feet along Executive
Order 1538 to Hawaii
Aeronautics Commission
and along Executive Order
2431 (New Waiakea Fire
Station Site);
3. 180° 00' 409.63 feet along Keaa Street;
4. 244° 25' 48" 109.00 feet along Kalanianaole
Street to the point of
beginning and containing
an area of 92,483 Square
Feet or 2.1231 Acres.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.

This subsection is conditioned upon the following:
(A) The petitioner, successors or its assigns shall comply
with all of the stated conditions of approval;
(B) Subdivision plans shall be submitted for tentative
approval within one year from the effective date of the
zone change. Final subdivision plans shall be submitted
within one year from the date of receipt of tentative
approval; (C) Plans for two of the proposed lots shall be
submitted to the Planning Department for Plan Approval
within one year from the effective date of final
subdivision approval; (D) Construction on two of the
proposed lots shall commence within one year from the date
of receipt of Final Plan Approval and be completed within
two years thereafter; (E) Accesses to the proposed lots
shall meet with the approval of the State Department of
Transportation, Highways Division and/or the County
Department of Public Works. Further, no access to the
proposed lots shall be allowed from Kalanianaole Street;
(F) The 20-foot wide future road widening strip along
Kalanianaole Street shall be set aside and delineated on
the subdivision plans; (G) A drainage system as required
by the Department of Public Works shall be installed; and
(H) All other applicable rules, regulations, and
requirements, including those of the Department of Water
Supply be complied with. Should any of the foregoing
conditions not be met, rezoning of the area to its
original or more appropriate designation may be initiated."
SECTION 2. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.
