ORDINANCE Nb.
AN ORDINANCE AMENDING SECTION 7.20 (THE KURTISTOWN ZONE MAP),
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE,
AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM
AGRICULTURAL (A-5a) TO SINGLE FAMILY RESIDENTIAL (RS-20) AT
OLAA, PUNA, HAWAII, COVERED BY TAX MAP KEY 1-7-06:13.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.20, Article 2, Chapter 8 (Zoning
Code), of the Hawaii County Code, as amended, is further
amended to add a new subsection, to read as follows:
"7.20 ( h ). The district classification of the
following area situated at Olaa, Puna, Hawaii, shall be
Single Family Residential (RS-20):
Beginning at the southwest corner of this parcel of land,
on the north side of the Volcano Hiqhway, the coordinates
of said point of beginning referred to Government Survey
Triangulation Station "OLAA" being 7920.95 feet South and
3195.00 feet West and running by azimuths measured
clockwise from True South:
1. 131° 15' 704.10 feet along Grant 4958
to Sol Kaluna, (Lot 32
of Olaa Homestead
Reservation Lots);
2. 221° 15' 120.39 feet along the
remainder of
Grant 4942 to
Koakulana, (remainder
of Lot 38 of Olaa
Homestead Reservation
Lots);
3. 311° 15' 723.40 feet along the
remainder of
Grant 4942 to
Koakulana, (remainder
of Lot 38 of Olaa
Homestead Reservation
Lots);
4. Thence along the north side of the Volcano Highway,
along a curve to the
right having a radius
of 2824.79 feet, the
chord azimuth and
distance being:
50° 21' 34"
121.93 feet to the
point of beginning and
containing an area of
1.974 Acres.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
This subsection is conditioned upon the following:
(A) the petitioner or its authorized representative shall
be responsible for complying with all of the stated
conditions of approval; (B) subdivision plans shall be
submitted for tentative approval within one year from the
effective date of the zone change. Final subdivision
plans shall be submitted within one year from the
effective date of tentative subdivision approval;
(C) construction of another single family dwelling shall
commence on one of the lots within one year from the date
of receipt of final subdivision approval and be completed
within one year thereafter; (D) a drainage system as
required by the Department of Public Works shall be
installed; and (E) all other applicable rules,
regulations, and requirements, including those of the
Department of Water Supply, shall be complied with.
Should any of the foregoing conditions not be met,
rezoning of the area to its original or more appropriate
designation may be initiated."
SECTION 2. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.

SECTION 3. This ordinance shall take effect upon its
approval.
