ORDINANCE NO. 8~
AN ORDINANCE AMENDING SECTION 7.03 (THE SOUTH KONA ZONE MAP),
ARTICLE 2, CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE,
AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM
AGRICULTURAL (A-la) TO AGRICULTURAL (A-5a) AT KEOPUKA AND
KAAWALOA, SOUTH KONA, HAWAII, COVERED BY TAX MAP KEY 8-1-23:3
AND PORTIONS OF 2, 4, 5 & 27.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.03, Article 2, Chapter 8 (Zoning
Code) of the Hawaii County Code, as amended, is further amended
to add a new subsection, to read as follows:
"7.03 (hh ). The district classification of the
following area situated at Keopuka and Kaawaloa, South
Kona, Hawaii, shall be Agricultural (A-Sa):
Beginning at the southwest corner of this parcel of land,
the northwest corner of Lot F-36 of Kaawaloa Coffee Farm
Lots, the coordinates of said point of beginning referred
to Government Survey Triangulation Station "PUU 0 HAU"
being 5,991.64 feet South and 13,867.31 feet East and
running by azimuths measured clockwise from True South:
1. 139° 10' 1,017.69 feet along F-35 of
Kaawaloa Coffee Farm Lots
and along Captain Cook
Subdivision, Unit 2;
2. 252° 52' 17.86 feet along the stonewall,
along the remainder of
Grant 1161 to J.D. Paris;
3. 242° 22' 35.90 feet along the stonewall,
along the remainder of
Grant 1161 to J.D. Paris
and along the remainder of
R.P. 4386 and 7532, L.C.
Aw. 8452, Apana 10 to
A. Keohokaole;
Thence following along the
stonewall, along the
remainder of R.P. 4386 and
7532, L.C. Aw. 8452,
Apana 10 to A. Keohokaole
for the following thirteen
(13) courses, the azimuths
and distances between
points being:
4. 237° 32' 91.30 feet;
5. 245° 02' 176.60 feet;
6. 234° 12' 105.70 feet;
7. 248° 22' 27.50 feet;
8. 231° 52' 44.20 feet;
9. 238° 32' 41.20 feet;
10. 249° 52' 23.00 feet;
11. 238° 32' 27.60 feet;
12. 225° 42' 53.90 feet;
13. 167° 42' 27.00 feet;
14. 184° 12' 21.00 feet;
15. 200` 12' 46.30 feet;
16. 208° 32' 50.90 feet;
17. 206° 02' 46.20 feet partly along
stonewall, along the
remainder of R.P. 4386 and

20. 199° 40' 60.72 feet to a pipe (found);
21. 243` 17' 134.82 feet along Grant 1171. to
P. Cummings;
22. 344° 59' 1,086.37 feet along the remainder
of Lot H-5, the remainder
of Lot H-4, across
Road "A" and along the
remainder of Lot H-2 to
the northwest side of
Lot F-36 of Kaawaloa
Coffee Farm Lots;

23. 56° 41' 176.95 feet along Lot F-36 of
Kaawaloa Coffee Farm Lots;
24. 36° 11' 30" 379.60 feet along Lot F-36 of
Kaawaloa Coffee Farm Lots
to the point of beginning
and containing an area of
16.160 Acres.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
This subsection is conditioned upon the following:
(A) The petitioner or its authorized representative(s)
shall be responsible for complying with all of the
conditions listed under Variance Permit No. 28, including
the dedication of the properties for agricultural uses; and
(B) All of the applicable rules, regulations, and
requirements be complied with. Should any of the foregoing
conaitions not be met, rezoning of the properties to their
original or more appropriate designation may be initiated."
SECTION 2. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 3. This ordinance shall take effect upon its
approval.
