ORDINANCE N0. 9Q3
AN ORDINANCE AMENDING ARTICLE 26, CHAPTER 8 (ZONING CODE) OF THE
HAWAII COUNTY CODE, AS AMENDED, RELATING TO SUPPLEMENTARY USE
REGULATIONS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 2-C-5, Article 26, Chapter 8 of the Hawaii
County Code is amended to read as follows:
"5. In all districts except V, CN, S and 0 districts:
hospitals; old age, convalescent, nursing, and rest homes
and other similar uses devoted to the care or treatment of
the aged, the sick, or the infirm having a minimum lot area
of one (1) acre in RS, RD, RA and RM districts.["]
The one acre minimum lot area requirement shall not apply
to care homes and boarding homes licensed by the Department
of Health and Department of Social Services as defined in
Article 1, Section 3 as amended."
SECTION 2. Material to be repealed is bracketed. New material
is underscored. In printing this ordinance, the brackets, bracketed
material and underscoring need not be included.
SECTION 3. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts
of this ordinance.
SECTION 4. This ordinance shall take effect upon its approval.
