AN ORDINANCE AMENDING SECTION 25-114 (CITY OF HILO ZONE MAP),
ARTICLE 3, CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY CODE,
AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE
FAMILY RESIDENTIAL (RS-15) TO SINGLE FAMILY RESIDENTIAL (RS-10)
AT WAIAKEA, SOUTH HILO, HAWAII, COVERED BY TAX MAP KEY
2-4-10:33.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 25-114, Article 3,_Chapter 25, (Zoning
Code), of the Hawaii County Code, is further amended to change
the district classification of property described hereinafter
as follows:
25-114. The district classification of the following
area situated at Waiakea, South Hilo, Hawaii, shall be
Single Family Residential (RS-10):
Beginning at the Northeast corner of this parcel of land,
also being the Southeast corner of Lot 9 on the West side
of Kehaulani Street, the coordinates of said point of
beginning referred to Government Survey Triangulation
Station "HALAI" being 10,978.28 feet South and 7.905.98
feet East and running by azimuths measured clockwise from
True South:
1. 355° 40' 100.00 feet along
Kehaulani
2. 85° 40' 222.00 feet along
3. 175° 40' 100.00 feet along
11932:2 to
Clark;
the west side of
Street;
Lot 7;
Grants 11791 and
Mrs. Lily Piltz
4. 265° 40' 222.00 feet along Lot 9 to the point
of beginning and containing an
area of 22,200 Square Feet.
All as outlined in red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof.
This change in district classification is conditioned
stated conditions of approval of the zone change; (B)
subdivision plans shall be submitted within one year from
the effective date of the zone change; (C) the
construction of a single-family dwelling shall commence on
one of the lots within one year from the date of receipt
of final subdivision approval and be completed within one
year thereafter; (D) Should an improvement district or
similar arrangements be initiated for the improvement of
Kehaulani Street, the landowners shall automatically
participate in such an arrangement; (E) a drainage system
in accordance with the requirements of the Department of
Public Works shall be installed; and (F) all other
applicable rules, regulations and requirements shall be
complied with. Should any of the foregoing conditions not
be met, rezoning of the area to its original or more
appropriate designation may be initiated.
SECTION 2. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.
