ORDINANCE N0. 84 S
AN ORDINANCE AMENDING SECTIONS 23-20 AND 23-21, DIVISION 2,
ARTICLE 2, CHAPTER 23 (SUBDIVISION CODE) OF THE HAWAII COUNTY
CODE 1983, AS AMENDED, RELATING TO VARIANCES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 23-20, Division 2, Article 2,
Chapter 23 of the Hawaii County Code 1983, is amended to read
as follows:
"Section 23-20. Appeal of director's action (by
applicant).
(a) If the director denies the applica*_ion, such
decision is final except tha*_, within [ten
working] thirt days after notice of *_he
decision, the applicant may appeal such action
to the planning commission."
SECTION 2. Section 23-21, Division 2, Article 2,
Chapter 23 of the Hawaii County Code 1983, is amended to read
as follows:
"Section 23-21. Fur*_her appeal rights.
(a) All actions of the planning commission are final
except that, within [ten working] thirty days
after notice of action, the applicant or an
"interested par*_y", [(] as defined in
sec*_ion 23-19 of this article [)], in the
proceeding before *_he planning commission, may
appeal such action to *_he board of appeals in
accordance with its rules."
SECTION 3. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material and underscoring need not be
included.
SECTION 4. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.
SECTION 5. This ordinance shall take effect upon its
approval.
