ORDINANCE NO. ~~ 13
AN ORDINANCE AMENDING SECTION 25-94 (KAMUELA ZONE MAP), ARTICLE 3,
CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY CODE, BY CHANGING THE
DISTRICT CLASSIFICATION FROM SINGLE FAMILY RESIDENTIAL (RS-10) TO
NEIGHBORHOOD COMMERCIAL (CN-7. 5) AT PUUKAPU HOMESTEADS, SOUTH KOHALA,
HAWAII, COVERED BY TAX MAP KEY 6-4-06:PORTION OF 22.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 25-94, Article 3, Chapter 25 (Zoning Code) of
the Hawaii County Code, is amended to change the district
classification of property described hereinafter as follows:
The district classification of the following area situated
at Puukapu Homesteads, South Kohala, Hawaii, shall be
Neighborhood Commercial (CN-7. 5):
Beginning at the Southeast corner of this parcel of land, also
being the North corner of Lot D-4, and on the Westerly side of
Lot 3 of the Puukapu Homesteads, 1st Series, the coordinates of
said point of beginning referred to Government Survey
Triangulation Station "WEST BASE" being 1,348.28 feet South and
1,147.91 feet East and running by azimuths measured clockwise
from True South:
1. 70° 21' 137.39 feet along Lot D-4 and Lot D-3;

Exhibit "A" and by reference made a part hereof.
SECTION 2. This change in district classification is conditioned
upon the following: (A) the change of zone ordinance shall become
effective only upon the awarding of a.contract for the construction of
within two years from the date the ordinance is signed by the Mayor;
provided further that a maximum one-year extension to the two-year
time limit may be granted by the Planning Director with reasonable and
sufficient justification. No development plans for the affected
portion of the property shall be acted upon until after the effective
date of the change of zone. The Planning Director shall be mandated
to initiate action to seek the repeal of the ordinance if the
above-cited terms have not been complied with or if the appropriation
for the project is lapsed, whichever occurs sooner; (B) the
petitioner, successors or its assigns shall be responsible for
complying with all of the stated conditions of approval of the zone
change; (C) plans for the proposed development shall be submitted to
the Planning Department for plan approval within one year from the
effective date of the zone change; (D) construction shall commence
within one year from the date of receipt of final plan approval and be
completed within two years thereafter; (E) access to the proposed
development from Mamalahoa Highway shall meet with the approval of the
Department of Public Works; (F) a drainage system in accordance with
the requirements of the Department of Public works shall be installed;
(G) the method of sewage disposal shall meet with the approval of the
appropriate governmental agencies; and (H} all other applicable rules,
regulations and requirements shall be complied with. Should
conditions B through H not be met, rezoning of the property to its
original or more appropriate designation may be initiated.
SECTION 3. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts of
this ordinance.
SECTION 4. This ordinance shall take effect upon its approval.
